The present Criminal Miscellaneous Petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for a direction to the learned Trial Court to expedite the trial of the Criminal Case No. 2595 of 2022, which is pending since 2022, before the learned Judicial Magistrate First Class, Bilaspur.

Learned counsel for the petitioner would submit that, till date only the complainant has been examined as the witness. He would further submit that, there is no considerable progress in the trial of the case

since 2022 and the petitioner is facing trial for the offence under Sections 294, 384, 506, 34 of IPC.

On the other hand, learned counsel appearing for the State would submit that they have no objection, if a direction is given to the learned Trial Court to expedite the trial of the case.

I have heard learned counsel for the parties and perused the material annexed with the petition.

From perusal of the order sheets of the Trial Court, it transpires that though the case was fixed for recording evidence of the parties, however, the witnesses are not turning up to record their evidence and the proceedings are adjourned for one or other reason. The charge sheet was filed against the petitioner on 24.05.2022 and charges were framed on 17.06.2022. Thereafter, the case was fixed for recording evidence of the prosecution witnesses, however, except on a few occasions, the witnesses are not turning up.

Be that as it may, it transpires that the criminal case against the petitioner is pending since 24.05.2022. The learned Trial Court is directed to expedite the trial of the case and to conclude the same as early as possible, preferably within six months from the next date fixed before it.

With the aforesaid observations, the present CRMP is disposed of .
