The present criminal misc. petition is filed by the petitioner for a direction to the respondent authorities to submit a final report after concluding the investigation with respect to Crime No. 441/2024 registered at Police Station Basna, District Mahasamund on 28.09.2024.

Learned counsel for the petitioner would submit that the petitioner was met with an accident on 05.08.2024 at about 10:30 am near village

Patharla by a passenger bus of Singh Travels by which he received grievous injuries and when the petitioner recovered from injuries, he made a written complaint to the police on 29.08.2024 against the driver of the passenger bus No. CG 10 G 5125 and then the FIR of Crime No. 441/2024 was registered by police of Police Station Basna, District Mahasamund. He would further submits that even after registering the FIR against the driver of the passenger bus No. CG 10 G 5125 for the offences under Section 281, 125(a) and 125(b) of BNS, 2023, the investigation was not carried out and final report has not been filed by the police till date, therefore, the authorities may be directed to conclude the investigation and file a final report before the competent Court.

On the other hand, learned counsel appearing for the State, on instruction, would submit that earlier on the written complaint made by the petitioner against the driver of passenger bus No. CG 10 G 5125, the FIR was registered on 28.09.2024, however, on investigation it was found that the passenger bus No. CG 10 G 5125 is not involved in the accident and from the RTO portal it is found that the said registration number is not allotted to any passenger bus, thereafter, closure report No. 05/2025 was prepared on 26.03.2025. Thereafter, on 08.08.2025 the petitioner again made a written complaint, in which he disclosed the another registration number of bus bearing UP72 BT 3858 and then the investigation of the case is re-opened and the police is trying to trace out the owner as well as driver of the said passenger bus of bearing registration No. UP72 BT 3858. He would further submits that since the alleged passenger bus belongs to the State of Uttar Pradesh,

therefore, sometime may be granted to them to conclude investigation and to file the final report in accordance with law.

I have heard learned counsel for the parties and perused the material annexed with the present petition.

From perusal of the FIR Annexure P/1 it transpires that the petitioner has made a written compliant on 29.08.2024 informing the police that he met with an accident by passenger bus No. CG 10 G 5125, whereas on 08.08.2025 he again informed the police that earlier bus number was not the correct bus number but passenger bus by which he met with an accident bearing registration No. UP72 BT 3858. From the communication submitted by the learned State counsel dated 25.10.2025, it also transpires that the closure report No. 05/2025 dated 26.03.2025 was re-opened on the written complaint made by the petitioner dated 08.08.2025 in which the investigation is going on.

Be that as it may, further three months time is granted to the respondents to carry out the investigation in the offence of Crime No. 441/2024 registered at Police Station Basna, District Mahasamund and to submit final report in accordance with law before the competent Court having jurisdiction.

Accordingly, the present CRMP is disposed of.
