2. The present petition has been filed by the petitioners with the following prayers:

“ A. To call for the records/ case diary of the instant case.

B. That that this Hon'ble Court may kindly be pleased to quash the impugned FIR bearing crime no. 247/2025 dated 18/07/2025 registered at Police Station - Padhmanabhpur, District - Durg (Annexure P- 2) and registered on the instance of the respondent no. 2/ complainant for the offence punishable under section 420, 468 & 34 IPC, in pursuance of the order passed by the Learned Judicial Magistrate First Class, Durg dated 09.06.2025 in MJC Criminal 23408/2025.

C. That this Hon'ble Court may kindly be pleased to quash the order passed by the Learned Judicial Magistrate First Class, Durg (CG) dated 09.06.2025 in M.J.C Criminal 23408/2025 (Filing Number) (Anup Sahu Vs. Roop Singh Dewanagn) (Annexure P-1) preferred by the Respondent No. 2 under section 175(3) of Bharatiya Nagarik Suraksha Sanhita, 2023.

D. Any Other relief which this Hon'ble Court deems fit and proper, may also kindly be granted to the petitioners, in the interest of justice. ”

Learned counsel for the petitioners submits that in the present case, charge-sheet has been filed before the competent Court against the petitioners and charges have been framed, therefore, he seeks to withdraw this petition with liberty to take legal recourse as available to them under the law.

Permission is granted.

Accordingly, the CRMP is dismissed as withdrawn with the aforesaid liberty, as prayed for.
