Heard on I.A. No.01/2023 – an application for condonation of delay in filing of instant criminal miscellaneous petition.

Upon due consideration and for the reasons assigned in the application, the same is allowed.

Delay of 114 days in filing the appeal is hereby condoned.

Also heard on application for grant of leave to appeal under Section 378(3) of the Code of Criminal Procedure.

Learned counsel appearing for the petitioner/State submits that the learned Trial Court has erred in discarding the last-seen circumstance merely on the ground of the seven-day gap between the deceased being last seen with the accused i.e. on 05.02.2018, and recovery of the dead body i.e. on 12.02.2018. She further submits that there is no fixed period of time which, by itself, renders the last-seen circumstance inadmissible, and since the accused having been last seen with the deceased and thereafter no evidence of any other person being seen with the deceased,

therefore, the finding of the learned Trial Court warrants interference.

We have heard learned counsel for the petitioner/State, considered her submissions, and have also perused the material available on record.

Upon consideration thereof, we are inclined to admit the appeal and the application for grant of leave to appeal is hereby admitted . Registry is directed to register the instant case as regular Acquittal Appeal.

Let a bailable warrant be issued to the sum of Rs.5,000/- against the applicant, as per rules, through the concerned Superintendent of Police for his appearance before this Court on 05.11.2026 .

In view of the above, present CRMP stands disposed of.

Let the Acquittal appeal be listed on 5^th of November, 2026.
