2. The present petition has been filed by the applicant with the following prayer:

“ It is respectfully prayed that the Hon’ble Court may kindly be pleased to quash the FIR charge-sheet and criminal proceeding bearing Crime No. 317 of 2023 dated 15.04.2023 registered at Police Station Supela, District Raigarh (C.G.) against the present appellant for offence under Section 195A, 294, 506(B), 323, 354, 34 of IPC which is gross abuse of process of law, illegal and against the provision of law and thus liable to quash, in the interest of justice. ”

Learned counsel for the applicant submits that the present petition has been filed for challenging the FIR registered as Crime No. 317 of 2023, the charge-sheet, and the consequential criminal proceedings arising therefrom. However, owing to an inadvertent typographical error, the charge-sheet pertaining to Crime No. 318 of 2023 has been annexed and referred to in the petition instead of the charge-sheet relating to Crime No. 317 of 2023. In view of the aforesaid defect, learned counsel seeks permission of this Court to withdraw the present petition with liberty to file a fresh petition challenging the correct proceedings.

4. Learned counsel appearing for the State has no objection to the aforesaid prayer.

5. Considering the submissions advanced and in view of the inadvertent error in filing the relevant documents, the present petition is dismissed as withdrawn , with liberty reserved in favour of the

applicant/petitioner to file a fresh petition in accordance with law with correct particulars and documents.
