1. The present Appeal is directed against the judgment of conviction and order of sentence dated 03.04.2008 passed by the 1st Additional Sessions Judge, Ambikapur, District Surguja in Sessions Trial No.404/2007, whereby the Appellant has been convicted for the offence under Section 307 IPC and

sentenced to undergo RI for 7 years with a fine of Rs.1,000/and in default of payment of fine, to undergo additional RI for 6 months.
2. In the present Appeal, pursuant to the bailable warrant issued by this Court, the Appellant was produced before this Court on 10.09.2026.
3. On being asked, the Appellant stated that he had already undergone the entire sentence imposed upon him, released from jail and had not made any request for continuation of the present Appeal. On the said date, the Appellant was ordered to be released on furnishing a bail bond of Rs.5,000/-.
4. Learned State Counsel submits that he has verified the aforesaid fact and confirms that the Appellant has already undergone the entire sentence imposed upon him.
5. In view of the aforesaid facts and circumstances and as the Appellant has not sought continuation of the present Appeal, the Appeal is dismissed . Sd/-
