This appeal under Section 14-A(2) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989, (for short, 'Act of 1989') is filed against impugned order dated 02.04.2026 passed by learned Special Judge under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Kawardha, District Kabirdham (CG) in Crime No.72/2026, whereby appellants’ application for grant of bail is rejected.

Appellants are in jail since 01.04.2026 in connection with Crime No.72/2026 registered at Police Station – Pipariya, District Kabirdham (C.G.), for the offence punishable under Section 296, 115(2), 351(3), 333, 3(5) of BNS and Section 3(1)(r) of the SC/ST (Prevention of Atrocities) Act, 1989.

As per case of prosecution, the appellants along with some other coaccused persons entered into the house of the complainant and abused him with filthy languages and assaulted him by clubs and it is alleged that the the accused persons abused the complainant by caste and when the scuffle was tried to be intervened some persons, accused persons were also abused and assaulted them. On the basis of report lodged by the complainant, offence was registered against the appellants. During the course of investigation, the appellants and other co-accused were arrested on 01.04.2026.

Learned counsel for appellants submits that appellants have been falsely implicated in this case, he has not committed any offence as alleged against them. He further submits that the dispute took place between the parties on the Holy festival, and thereafter the dispute has been settled between the parties. He further submits that except Section 3(1)(r) of the Act, 1989 and Section 333 of BNS, other offences are bailable in nature and the appellants are in jail since 01.04.2026 and conclusion of trial may take time, hence, appellants may be released on bail.

Learned State counsel opposes the submission made by learned counsel for the appellants.

Despite service of notice to the complainant, no one appeared on behalf of him.

I have heard learned counsel for parties and perused the record.

¶26

Considering the facts and circumstances of the case, the nature of allegation leveled against the appellants, the detention period of the appellants, and that the conclusion of the trial is likely to take some time, without expressing any opinion on the merits of the case, this Court is of the opinion that the present is a fit case for grant of bail to the appellants. Accordingly, the appeal is allowed.

It is directed that, in the event of the appellants executing a personal bond in the sum of Rs. 20,000/- each with one surety to the satisfaction of the concerned trial Court, they shall be released on bail on the following conditions:-

(i) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court,

(ii) they shall not act in any manner which will be prejudicial to fair and expeditious trial, and

¶30

(iii) they shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.

(iv) they shall not involve himself in any offence of similar nature in future.
