After arguing for some time, learned counsel for the applicants seeks permission of this Court withdraw this petition. He also submits that applicants' (defendant No.2 and 3) written statement has not been filed yet before the trial Court, therefore, liberty may be granted to raise all the grounds including issue of limitation in written statement before the learned Court below, in accordance with law.

On due consideration, prayer made by the petitioner is allowed.

Accordingly, the Civil Revision is disposed of as withdrawn reserving the liberty as prayed for.
