This contempt petition under Section 12 of the Contempt of Courts

Act read with Article 215 of the Constitution of India has been

preferred by the applicant alleging non-compliance of the order (Annexure C-1) dated 24-04-2025 passed by this Court in WPS No. 2832/2024 and WPS No. 218/2025.

Learned counsel for the applicant submits that, by order dated 2404-2025 passed in WPS No. 2832/2024 and the connected matter, this Court held that the Board of Governors of the Indian Institute of Management is the appointing authority of the petitioner and, therefore, a charge-sheet could be issued only with the approval of the Board of Governors. On the basis of the said finding, the Coordinate Bench quashed the charge-sheet dated 18-04-2024. He further submits that, despite the aforesaid order, the respondent again placed the petitioner under suspension vide order (Annexure C-2) dated 28-04-2025 and issued a fresh charge-sheet on the same date. According to him, the said action amounts to willful disobedience of the order (Annexure C-1) dated 24-04-2025 passed by the Coordinate Bench.

Per contra, learned counsel for the respondent submits that the subsequent suspension order as well as the charge-sheet have already been quashed by the Coordinate Bench vide order (Annexure C-3) dated 09-05-2025 passed in WPS No. 3209/2025. He further submits that, as on date, neither the suspension order nor any charge-sheet against the petitioner survives. The aforesaid factual position has also been fairly conceded by learned counsel for the applicant.

Having considered the submissions advanced by learned counsel for the parties and taking into account the fact that the subsequent suspension order as well as the charge-sheet have already been quashed by the Coordinate Bench and no disciplinary proceedings are presently pending against the petitioner, nothing remains in the present contempt petition.

Accordingly, the contempt petition stands disposed of.

The rule issued against the respondent is discharged and the contempt proceedings are dropped.
