X v. Vijendra Karsh
Case brief
What is this about?
Acquittal appeal by victim; consent; promise of marriage; love affair; prosecutrix cross-examination admissions; no divorce decree; Sections 376(2)(n) and 506-B IPC; Section 378 CrPC; scope of interference in appeal against acquittal; Jafarudheen v. State of Kerala (2022) 8 SCC 440; perverse findings; dismissal at admission stage; High Court of Chhattisgarh; ACQA No. 377 of 2025; Sessions Case No.24/2024; Raigarh.
What did the court decide?
From the evidence of the prosecutrix, who was admittedly a major lady, there was a love affair between her and the accused/respondent No.1 and she was a consenting party to the alleged offence, which is why she did not lodge a report when the alleged offence was committed upon her; taking note of her testimony, the learned trial Court committed no illegality in holding that the prosecutrix was a consenting party and in acquitting the accused.
