This Writ Petition has been filed for the following reliefs:-

"10.1 That, entire records pertaining to the petitioner's providing fund may be called for proper adjudication of the claims of the petitioner. 10.2 That, the Hon'ble Court may further be pleased to direct the respondents to, compute the

claim of the petitioner by considering his whole service and grant revised pay scale amounting to tune of Rs.7,61,059/- and release the same in favour of the petitioner at the earliest.

10.3 That, respondents be directed to compensate the petitioner for mental harassment and agony up to a tune of Rs.2,00,000/-."

Learned counsel for the petitioner submits that certain missing credits are required to be deposited into the GPF account by the office of Advocate General, however, no relevant information were provided from the Department/State in this regard and in the reply, the State has averred that they are not the proper competent Authority and competent Authority is the Accountant General.

On the other hand, learned counsel for the respondents jointly submit that there are certain missing credit entries in the GPF account of the petitioner. However, there is a High Powered Pension Committee constituted by the State for redressal of such grievances, therefore, the direction may be issued to refer the matter to the said Committee and, in turn, case of the petitioner shall be duly scrutinized and a decision shall be taken after due verification after obtaining relevant information, vouchers etc. related to GPF of the petitioner from the concerned Department. It is also submitted that similar issue has been resolved by the co-ordinate Bench of this Court in WPS No.7345/2017 (Naresh Chandra Shukla Vs. State of CG and Ors) decided on 23.07.2025, whereby, the matter was referred to High Power Pension Redressal Committee to decide the dispute.

Learned counsel for the petitioner would oppose the aforesaid submission and submits that there is no statutory provision with regard to

aforesaid Committee, therefore, appropriate direction may be issued to decide the claim of the petition in an expeditious manner.

Having regard to the entire fact situation of the case and nature of dispute, this Court finds that the matter should be preferred before the High Power Pension Redressal Committee to decide the dispute. Therefore, it is directed that the petitioner shall make representation before the said Committee for his claim with all relevant documents along with copy of this order within a period of 30 days from this order and, in turn, the Committee after affording due opportunity of hearing to the petitioner and other interested parties shall decide the claim of the petitioner within further period of 60 days.

It is also expected from the concerned Department/Authority that before Schedule of the said Committee meeting if there are any missing credits, pending vouchers etc. related to GPF, the same shall be supplied to the office of Accountant General and Committee in a prompt manner. Thereafter, the Committee shall decide the claim of the petitioner in an expeditious manner with the time stipulated above.
