This Writ Petition has been filed under Article 226 of the Constitution of India for the following reliefs:-

“10.1) This Hon'ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioners from the possession of the respondent authorities for its kind perusal.

10.2) That, the Hon'ble court be pleased to issue appropriate order/direction to the respondent to provide the present calculation in respect of family pension of the petitioner according to the provision of pension rules.

10.3) Any other relief or relief(s) which this Hon'ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.”

Necessary facts, in brief, are that the petitioner being widow is getting family pension, as her husband late Shri Dr. Ram Sewak Sharma had retired on 31.05.1992 from the post of Professor in Government Engineering college, Raipur C.G. and expired on 02.10.2016. At the time of his death, he was getting pension of Rs.43,267/-. Subsequently, the family pension was fixed. Since the petitioner is not aware as to whether she is getting the proper family pension or not, by way of this Writ Petition, a limited relief has been sought praying that the Authorities be directed to provide the

calculation of the family pension after its fixation in favour of the petitioner.

Learned counsel for the respondents would not oppose the aforesaid prayer.

Having considered the submissions of the parties and also considering that the petitioner herself is not aware as to whether she is getting the right pension or not and she has only sought the calculation of the pension, which is being paid to her after the fixation of the family pension, this Court deems it appropriate to direct Respondent No.2 to provide the calculation sheet of the family pension fixed in favour of the petitioner after the death of her husband on 02.10.2016, specifying the amount payable for each month. It is further directed that the above information shall be communicated to the petitioner, in an expeditious manner, preferably within an outer limit of 120 days from the date of passing of this order. Ordered accordingly.

With the aforesaid observation/direction, this Writ Petition stands disposed of.
