The petitioner has filed this petition seeking the following relief(s):-

“ 10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records pertaining to the petitioner's case.

10.2 That, this Hon'ble Court may kindly be pleased to allow the petition and quash the appointment of respondent no. 3 to 5 being illegal and direct the respondent no. 2 to advertise the posts afresh and start selection process according to provisions of law.

10.3 Thay any other relief, which this Hon'ble Court may deem fit and proper together with cost of the petition.”

Learned counsel for the petitioner would submit that there was illegal and stringent condition in the Advertisement that the candidates should have live registration in the Employment Office, Raigarh and such condition is violative of Articles 14, 16 and 21 of the Constitution of India.

On the other hand, learned counsel appearing for the respective respondents would submit that Condition No. 03 mentioned in Advertisement was modified by the Chief Medical and Health Officer vide Notification dated 04.06.2016 and instead of Raigarh, State of Chhattisgarh was substituted.

Heard learned counsel for the parties.

Taking into consideration the fact that Condition No. 03 of the Advertisement was modified by the Chief Medical and Health Officer on 04.06.2016, no direction or order can be passed in favour of the petitioner, therefore, this petition fails and is hereby dismissed .
