Heard Shri B.P. Singh and Shri Shikhar Bakhtiyar, learned counsel for the petitioner, Shri Saumitra Kesharwani, learned Panel Lawyer for the State and Shri Aditya Bharadwaj, learned counsel for respondent No.4.

Instant petition has been filed seeking following reliefs:-

“(i)That this Hon’ble court may kindly be pleased to set aside the order dated 08/12/2022.

¶22

(ii)That any other relief which this Court deems fit and proper may also be granted in favour of the petitioner safeguarding his interest.”

Learned counsel for the petitioner submits that though he is having valid grounds to challenge the impugned order (Annexure P-1), however since the private respondent No.4 has already completed training as Ophthalmic Assistant, as such at present he is not challenging the said order. Learned counsel for the petitioner submits that in the month of March a new list is coming and the petitioner is entitled to go for training as Ophthalmic Assistant in all respect. He would submit that considering the aspect that the petitioner has already challenged the previous order in which he was having entitlement to go for the training, however as the reply was not filed within time, this petition has become infructuous, as such the respondents may be directed to consider the candidature of the petitioner in the forth coming training programme.
