The petitioner who was working as Aagan Badi Worker has filed the present writ petition under Article 226 of the Constitution of India challenging the termination order dated 25.11.2020 (Annexure P-1) passed by the Chief Executive Officer, Janpad Panchayat Sarangarh, District Raigarh (C.G.) where by the services of the petitioner have been terminated.

Brief facts as reflected from the record are that the petitioner initially appointed as Aagan Badi Worker on 21.06.2013 and was posted at Gram Panchayat Chhote Khaira, thereafter, she discharging her duty without any hindrance, all of the sudden her services by the impugned order dated 25.11.2020 have been terminated by the respondent Chief Executive Officer, Janpad Panchayat Sarangarh, District Raigarh (C.G.). This termination order dated 25.11.2020 is being assailed by the petitioner before this Court by filing this writ petition.

Learned counsel for the petitioner would submit that without issuance of show cause notice or compliance of principle of natural justice her services were terminated, thus he would pray for allowing the writ petition.

On the other hand Mr. Tarkeshwar Nande, learned State counsel and Mr. Ghanshyam Patel, learned counsel for respondent No. 4 would submit that the Petitioner has alternative and efficacious remedy of filing appeal as per circular issued by the Government on 02.04.2008 under Rule 3 of Chhattisgarh Panchayat (Appeal and Revision) Rule 1995 which provide that any order passed by the Janpad Panchayat is appellable before the competent

authority and would pray for dismissal of writ petition. He would further submit that the petitioner has alternative and efficacious remedy available under Chhattisgarh Panchayat (Appeal and Revision) Rule 1995, therefore, this petition is not maintainable.

I have heard learned counsel for the parties and perused the documents place on record with utmost satisfactions.

The Government on 02.04.2008 under Rule 3 Chhattisgarh Panchayat (Appeal and Revision) Rule 1995 has issued a circular. The relevant clause of circular is reproduced below as under:

“ 11. अपीलः -

आंगनवाड़ी का्቟�कቔኋा�/सहायि्቟काओं की निन्቟ुनि� की ्ቚनि�्቟ा में की गई निन्቟ुनि� से सहमቔኋ न होने पर अपील के ्ቚावधान इस ्ቚकार होंगेःक. जनपद पंचा्቟ቔኋ ्ቛारा च्቟न/निन्቟ुनि� निक्቟े जाने पर च्቟न/निन्቟ुनि� आदेश के निवरू्ሾ निवनिहቔኋ ्ቚनि�्቟ा के ቔኋहቔኋ अपील छ्ቈीसगढ़ पंचा्቟ቔኋ राज अयिधनिन्቟म 1993 के ्ቚावधानों के ቔኋहቔኋ निवनिहቔኋ अयिधकारी के सम्ቌ की जा सकेगी । ख. छ्ቈीसगढ़ नगर पालिलक निनगम अयिधनिन्቟म 1956 के अंቔኋग�ቔኋ गनि3ቔኋ नगर पालिलका निनगमों में निन्቟ु� निक्቟े ग्቟े आंगनवाड़ी का्቟�कቔኋा�ओं/सहायि्቟काओं के मामलों में जिजला कलेक्टर को अपील की जावेगी ।

ग. जिजला कलेक्टर के आदेश के निवरू्ሾ नि्ቛቔኋी्቟ अपील आ्቟ु�/संचालक ्ቚशासन एवं निवकास को की जावेगी । घ. छ्ቈीसगढ़ नगर पालिलका अयिधनिन्቟म 1961 के अंቔኋग�ቔኋ गनि3ቔኋ नगर पालिलका परिरषद्/नगर पंचा्቟ቔኋ में निन्቟ु� निक्቟े ग्቟े आंगनवाड़ी का्቟�कቔኋा�ओं/सहायि्቟काओं के मामले में अनुनिवभागी्቟ अयिधकारी (राजस्व) को अपील की जावेगी ।

ड. अनुनिवभागी्቟ अयिधकारी (राजस्व) के आदेश के निवरू्ሾ जिजला कलेक्टर को नि्ቛቔኋी्቟ अपील की जावेगी । च. निद मूल ् ांकन सनिमयिቔኋ ्ቛारा च्቟न निक्቟ा जाቔኋा है ቔኋो अपील जिजला कलेक्टर के सम्ቌ की जावेगी ।

सप् ् ቖ ीकरणः - चूॅनिक इन निनदEशों के ቔኋहቔኋ कृቔኋ निन्቟ुनि�्቟ों के निवरू्ሾ अपील का ्ቚावधान निक्቟ा ग्቟ा है अቔኋः शिशका्቟ቔኋें ्ቚा्቎ होने पर संबंयिधቔኋ शिशका्቟ቔኋकቔኋा� को अपील की ्ቚनि�्቟ा की निवस्ቔኋृቔኋ जानकारी दी जाकर अपील करने का सुझाव निद्቟ा जाना चानिह्቟े ।”

Considering the circular dated 02.04.2008 issued by the Government and the petitioner has alternative and efficacious remedy as aforestated, I am of the view that the writ petition is not

maintainable at this juncture.

Accordingly, liberty is granted to the petitioner to prefer an appeal under Chhattisgarh Panchayat (Appeal and Revision) Rule 1995 within 45 days from the date of receipt of the copy of the order and in turn the Appellate authority shall decide the appeal on the merit and neither the petitioner nor the respondent will take a plea of limitation, as this Court has already condoned the delay.

It is made clear that this Court has not commented on the merit of the case or contentions are left open which will be adjudicated and decided by the appellate authority in accordance with law.

With aforesaid observation and liberty granted in favour of the petitioner, present writ petition is disposed of with aforesaid
