1. The present writ petition has been filed by the petitioners with the following relief(s) :

“10.1 That this Hon'ble Court may kindly be pleased to call the record of case from the respondent authorities.

¶23

10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ, thereby quashing/ settingaside the impugned order dated 26.09.2023 (Annexure P/1) and further be pleased to direct the respondent authorities to allow the petitioner to run allotted fair price shop of Gram Panchayat, Jaitpuri.

10.3 That any other relief/order which may deem fit and just in the facts and circumstances of the case including award of the cost of the petition may be given.

2. Learned counsel appearing for the petitioner submits that the instant

writ petition is being preferred against the impugned order dated 26.09.2023 (Annexure P/1), whereby without affording proper opportunity of hearing in violation of Chhattisgarh Public Distribution System (Control) Order, 2016, the respondent no. 3 has suspended the work of Govt. Fair Price Shop allotted to the petitioner and attached the said work in the respondent no. 5 Samiti. It is further submitted that since the impugned order has been issued by the respondent no. 3, without complying the statutory standing Order, 2016, therefore the petitioner has no alternative remedy except to approach the Hon'ble Court under Article 226 of the Constitution of India. It is further submitted that in identical matters bearing Writ Petition (C) No. 5161/2024, Writ Petition (C) No. 726/2024, W.P.(C) No. 78/2024, W.P.

(C) No. 4098/2023 & W.P.(C) No. 3603/2021, this Court has passed orders and the case of petitioner is similar. Hence, this petition.

3. Learned State counsel contended that the concerned authority shall consider and conclude the enquiry as per law.

4. I have heard learned counsel for the parties and perused the documents with utmost circumspection.

5. Considering facts of the case, submissions of counsel for the respective parties, this writ petition is disposed of directing to respondent No.3 – Sub Divisional Officer (Revenue), Masturi, District Bilaspur (C.G.) to conclude the enquiry expeditiously preferably within a period of ‘30 days’ from the date of receipt of copy of this order, in accordance with law and complying with the provisions of Section 16(3) of the Standing Order, 2016.

6. It is made clear that this Court has not expressed any opinion on the merits of the case.

7. Accordingly, the instant petition is disposed of.
