By way of this petition, the petitioner is seeking compensation of allotment of land from the respondent authorities in lieu of his registered agricultural land which was not acquired but a road has been constructed in the middle of his land forcibly by the Public Works Department. He therefore has prayed for the following reliefs:

10.1. This Hon’ble Court may kindly be pleased to direct the respondent authorities to make compensation or allot land to the petitioner in lieu of his land as per the provision of Right of Fair Compensation and Transparency in land acquisition Rehabilitation and Resettlement Act within one month.

10.2. Any appropriate writ, direction or order may also kindly be passed in favour fo the petitioners, which this Hon’ble Court deems fit in the circumstances of the case.

Counsel for the petitioner submits that the petitioner is a registered owner of the agricultural lands at village Sardha, PH NO. 24, Tahsil Lormi, district Mungeli bearing Khasra Np. 288/1 (area 0.3440 hectares) and 289/1 (area 0.2140 hectare) and has all the revenue records of the said lands. A road has already been constructed in the year 2022 by the Public Works Department, Lormi, District Mungeli in the middle of the land and the petitioner was neither informed or permission was taken from him or the lands were acquired. She submits that the petitioner was neither given compensation nor the land has given to him. She submits that the petitioner has already filed representation on 21.11.2022 to the SDO (R) Lormi, District Mungeli

however, the same has not been decided till date by the concerned authority.

Learned State counsel submits that let the petitioner make a fresh representation before the concerned authority and in turn his representation would be decided in accordance with law after due verification.

Considering the facts and circumstances of the case, the petition is disposed of with liberty to the petitioner to file fresh detailed representation assailing all his grievances along with rleevant documents raised in this petition along with this order before the respondents No. 2 & 3 within a period of 15 days from the date of receipt of the order who in turn shall decide the same in accordance with law after due verification within a period of 90 days from the date of filing of the representation of copy of the same in accordance with law/rules/regulations.

It is made clear that this Court has not observed anything on the merits of the case and it would be for the authority concerned to act strictly in accordance with law.

With the above observation, the petition stands disposed of.
