The present writ petition has been filed by the petitioner with the following relief(s) :

“(i) Issue a writ of mandamus directing the District Level Certificate Verification Committee to conduct an enquiry with respect to social status certification of Respondent No.5 under Section 6 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes, (Regulation of Social Status Certification), 2013.

(ii) Pass any other order the Hon’ble Court may deem fit in the interest of justice.”

Learned counsel for the petitioner contended that the respondent no. 5 has obtained a fake social status certificate. Respondent No. 5 belongs to Baretha OBC Caste, however, after marriage she changed her name from Jagriti Baretha to Jagriti Minj and has obtained false Scheduled Tribe, Caste Certificate. Respondent no. 5 is the daughter of Shri Radhe Shyam Baretha and prior to her marriage to Ajeet Pal Minj, she was none by the name Ku. Jagriti Baretha. Respondent No. 5's Class-10 and Class 12 Mark Sheet bear the name Jagriti Baretha. After getting married the petitioner completed her M.A. in Economics. The mark sheet bears the name Jagriti Minj W/o of Ajeet Pal Minj. She further

contended that the petitioner obtained respondent no. 5's mark sheets and initial appointment order under the RTI Act from the Government Higher Secondary School Hariharpur. The petitioner after having received the document under the RTI Act submitted complaint to the Director High Power Certification Scrutiny Committee, Secretary, Department of Scheduled Caste and Scheduled Tribe Development, Collector Surajpur. In the complaint the petitioner has stated that the respondent no. 5 Jagriti Minj was known as Jagriti Baretha prior to her marriage to Ajeet Pal Minj. After marriage she changed her surname from Baretha to Minj. Respondent No. 5's original Caste Baretha is an OBC Caste. On the basis of false documents respondent no. 5 obtained a fake Scheduled Tribe Certificate wherein her caste is mentioned as Oraon Scheduled Tribe and husbands name is mentioned as Ajeet Pal Minj. The petitioner has submitted before the authorities, that the caste status of a woman does not change after marriage. The petitioner has complained to the authorities, that respondent no. 5 has been illegally appointed as Shiksha Karmi Class-1, in the Scheduled Tribe Reserved Category on the basis of fake certificate. The petitioner requested the authorities to initiate proceedings under the Chhattisgarh Scheduled Castes, Scheduled Tribe and Other Backward Classes, (Regulation of Social Status Certification), 2013. Till date verification proceeding under the Chhattisgarh Scheduled Castes, Scheduled Tribe and Other Backward Classes, (Regulation of Social Status Certification), 2013 have not been completed. Therefore, it is prayed that directing the District Level Certificate Verification Committee to conduct an enquiry

with respect to social status certification of Respondent No.5 under Section 6 of the Chhattisgarh Scheduled Castes, Scheduled Tribes and Other Backward Classes, (Regulation of Social Status Certification), 2013.

Learned counsel for the State-respondent opposed the submission made by learned counsel for the petitioner.

I have heard learned counsel for the parties and perused the record with utmost circumspection.

Taking into consideration the fact that the relief which has been sought by the petitioner cannot be granted in exercise of writ jurisdiction and the petitioner has no locus to question the caste certificate of the respondent No.5, in view of the considered opinion of this Court, no case is made out for any interference.

Accordingly, the petition being devoid of any merit is liable to be and is hereby dismissed.
