The petitioner sought a direction to the Collector, Durg, to decide his representation dated 10.12.2024 complaining that respondent no. 6 (Rameshwar Chandrakar, brother of the petitioner's late father Sevak Ram Chandrakar) had obtained the paddy-procurement bonus/MSP share for 2014-15 and 2016-17 payable to the deceased, who died on 18.01.2022, before the bonus was declared by the State Government on 21.12.2023. Counsel for the State stated that if the representation remained pending it would be considered in accordance with law with opportunity of hearing to respondent no. 6 within a stipulated period. By the present writ petition, the petitioner is seeking a direction towards the Collector to decide the representation submitted before him on 10.12.2024, by which the petitioner has lodged a complaint against the authorities as well as the respondent no. 6, who has obtained the share of bonus of minimum support price provided by the Government for the Paddy Procurement year 2014-15, 2016-17, of Late Sevak Ram Chandrakar, who is the father of the petitioner and brother of respondent no. 6.

Learned counsel for the petitioner would submit that the father of the petitioner died on 18.01.2022, however when the bonus was declared by the State Government on 21.12.2023. The respondent no. 6 received the share of the petitioner’s father without intimating about the death of Late Sevak Ram Chandrakar.

Learned counsel for the State would submit that if the representation is still pending, the same will be considered in accordance with law by affording opportunity of hearing to the respondent no. 6 only within a stipulated period.
