1 . Heard Mr. Harsh Wardhan Agrawal, counsel for the petitioner. Also heard Mr. Sangarsh Pandey, Govt. Advocate for the Respondent/State.

The present writ petition has been filed by the petitioner with the following prayers

"10.1 That, the Hon'ble Court may be kindly pleased to call for the entire records pertaining to the grievance of the petitioner.

10.2 That, the Hon'ble Court may be kindly be pleased to declare Rule 11, 12 and the Chhattisgarh Scheduled Castes and Scheduled Tribes and Other Backward Classes (Regulation of Social Status Certification) Rules, 2013 and Form No.- 1A as unconstitutional and ultra vires being discriminatory and unreasonable.

10.3 That, the Hon'ble Court may be kindly pleased to declare that the petitioner's case for grant of permanent caste certificate is liable to be considered in the light of judicial pronouncements by the respondents.

10.4 That, the Hon'ble Court may kindly be pleased to grant any other relief which the Hon'ble Court deems

fit and proper in the facts and circumstances of the present case.

10.5 That, the Hon'ble Court in the facts and circumstances of the present case may further be pleased to grant cost of the petition to the petitioner.

At the very outset, the learned for the petitioner submitted that the social status of the applicant is being inquired into by the High Power Caste Scrutiny Committee and the matter is still sub-judice. Therefore, he may be permitted to withdraw the present petition with liberty to take recourse of law at an appropriate stage and appropriate forum.

In view of the above, the present petition is dismissed as withdrawn with liberty to avail the appropriate remedy if any cause of action arises further.
