1. This writ petition has been preferred under Article 226 of the

Constitution of India seeking following reliefs:

“ 10. RELIEF (S) SOUGHT

¶22

10.1 That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions quashing/setting-aside the order dated 08/01/2024 (Annexure P/1) passed by the Board of Revenue whereby the order dated 17/12/2020 passed by the Tehsildar and order dated 08/09/2022 passed by the Commissioner has been affirmed and order dated 07/02/2022 passed by Magistrate has been set-aside. the Sub Divisional

10.2 That, this Hon'ble Court may kindly be pleased to issue a writ/writs, order/orders, direction/directions holding that order passed by the SDM dated 07/02/2022 is well reasoned order.

10.3 Any other relief which may deems fit may also be awarded along with cost of the petition.”

2. Heard learned counsel for petitioner as well as learned counsel for the respondents on IA No.3/2025, application for taking compromise on record.

Learned counsel for the respective parties contended that petitioner and respondent No.2 have arrived into compromise, they have resolved their dispute, outside the court, on their own and free will, without any fear or pressure. The compromise deed dated 01.08.2025 (Annexure R-2/1) has also executed between the parties. They jointly prayed that the alleged document/Annexure R-

2/1 is relevant for just and proper, therefore the same may kindly be taken on record.

4. On due consideration of the above submission and the reasons mentioned in IA No.3/2025, same is hereby allowed. The document/Annexure R-2/1 is taken on record.

5. Also heard learned counsel for parties on IA No.4/2025, application for taking agreement dated 12.09.2025 on record.

Learned counsel for the petitioner as well as respondent No.2 have admitted the fact that the compromise dated 01.08.2025 shall not be acted by the parties as per subsequent agreement dated 12.09.2025 (Annexure -A), the same shall be acted after withdrawal of the criminal proceeding initiated by respondent No.2 against the petitioner.

7. On due consideration, IA No.4/2025 is hereby allowed. The document/agreement dated 12.09.2025 (Annexure -A) is taken on record. Learned counsel for the parties admitted they will acted upon the agreement dated 12.09.2025 (Annexure -A) and compromise deed dated 01.08.2025 (Annexure R-2/1).

In view of above, it is clear that during pendency of this writ petition, petitioner as well as respondent No.2 have entered into compromised and compromise deed dated 01.08.2025 (Annexure R-2/1) and agreement dated 12.09.2025 (Annexure -A) have also been executed between the parties. The petitioner and respondent No.2 admitted before this Court that they shall proceed further in

accordance with the compromise deed dated 01.08.2025 (Annexure R-2/1) and agreement dated 12.09.2025 (Annexure -A).

9. Accordingly, the writ petition is disposed of with the aforesaid observation and in the terms of the compromise/agreement executed between the parties.

10. It is also observed that the petitioner and respondent No.2 agree to file the compromise application before the concerned Courts.
