1. Counsel for the Petitioner prays for the following relief(s):-

(i)That, the Hon’ble Court may be pleased to issue a writ, order or direction or any other appropriate writ direction to respondent No. 3 to 8 forthwith release the admitted outstanding amount of Rs. 5,62,280/- to the petitioner along with interest, within a time-bound period as may be deemed fit by this Hon’ble Court;

(iv) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted.

2. Learned counsel for the petitioner submits that the petitioner is a marginal dairy farmer running a shop “Geedam Dairy”. He is aggrieved by the arbitrary and illegal inaction of the respondentauthorities in not releasing the admitted outstanding dues of Rs. 5,62,280/- for milk supplied to respondent No. 7, a cooperative society functioning under the control of the State Government. The respondent society, in acknoledgment of the outstanding dues, addressed a letter dated 09.12.2024 (Annexure P/3) to the Collector, South Bastar Dantewada, seeking financial assistance for the disbursement of pending payments to dairy farmers including the petitioner. The said letter enclosed a list of farmers to whom payments were due, and the name of the petitioner is found at serial No. 47 in the said list. In this regard, the petitioner has made representation for payment of the dues, but till date the same has not been disbursed, therefore she prays for a direction to the concerned authorities to decide his representation and the claim undisputed amount be released at the earliest.

Learned State Counsel submits that in view of the limited prayer made by the learned counsel for petitioner seeking direction to concerned authorities to consider the pending claim towards the payment of dues, he is having no objection to the limited prayer and if the admitted amount of the petitioner is pending, it will be considered and released in accordance with law.

4. I have heard learned counsel for the parties and perused the material available on record.

Considering the facts and circumstances of the case instead of keeping this petition pending, I find it appropriate to dispose of the same at this stage directing the respondent-authorities to consider/decide the claim of the petitioner as expeditiously as possible in accordance with law. If it is found that the petitioner is entitled for undisputed claim amount, the same shall be released at the earliest, subject to verification of the facts.

6. With the aforesaid direction, the writ petition is disposed of.
