1. Learned counsel for the petitioner submits that the application for recounting of general votes has not been decided by the respondent authorities. As such, the petition is filed.

2. Since, the result has already been declared in favour of the respondent No. 1 and she has been elected for the post of Sarpanch, Gram Panchayat-Dharrtipara, as such, the petitioner is required to file an appropriate election petition before the competent authority.

3. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw the petition with liberty to file an appropriate election petition before the prescribed authorities.

4. Prayer made is fair and reasonable.

5. Accordingly, the petition is dismissed as withdrawn with aforesaid liberty reserved in favour of the petitioner.
