Learned counsel for the petitioner at the outset seeks permission of this Court to withdraw this petition with a liberty to file a duly constituted Election Petition.

On the other hand learned counsel for the respondent has not opposed the prayer made by the learned counsel for the petitioner.

Permission is granted as the above submission is fair and reasonable. The learned counsel for the petitioner is directed to file appropriate Election Petition before the competent authority.

Accordingly, this petition is dismissed as withdrawn, however, the petitioner is at liberty to file appropriate Election Petition in accordance with law.
