The petitioner has filed the instant petition seeking review and recall of the order dated 30.7.2024 passed by this Court in WPS

No.457/2015 whereby the writ petition was dismissed as the counsel appearing for the petitioner pleaded no instructions.

It is well settled that scope of review jurisdiction is extremely limited and only an error apparent on face of record can be corrected in the said jurisdiction and re-appraisal/re-appreciation cannot be done in exercise of said jurisdiction as that would amount to exercise of appellate jurisdiction which is impermissible in law. In the present case, admittedly, on 30.7.2024 when the writ petition was taken up for hearing, the counsel appearing for the petitioner pleaded no instructions and therefore, this Court considering the fact that the petition is of the year 2015 and the petitioner has lost interest in pursuing the case due to efflux of time, dismissed the writ petition accordingly. Being so, there is no such error apparent on the face of record which can be rectified by way of review petition. Accordingly, the instant review petition being without any substance is liable to be and is hereby dismissed.
