On due consideration of the submissions made by the counsel for the applicant as also, the pleadings made in the application, I.A. No. 01/2025 is allowed. Delay in filing of the revision petition is condoned.

This MCC is filed by the applicant seeking review of the order dated 03.09.2024 passed by this Court in Writ Petition (C) No. 4395/2024.

Learned counsel for the applicant submits that in the cause-title of the order dated 03.09.2024, name of the husband of the applicant/petitioner is erroneously mentioned as ‘late Shri Chamru Yadav’ whereas, the correct name is ‘Mahettar Yadav’ and therefore, the cause-title be corrected.

Learned counsel for the respondent submits that there is no error apparent in the face of the order dated 03.09.2024, the description of the applicant is correctly mentioned, as mentioned in the writ petition.

I have heard learned counsel for the respective parties.

From perusal of the documents marked as Annexure P/3 to the writ petition, which are the applications submitted by the petitioner/applicant before the authority concerned for grant of compensation on account of death of her husband due to electrocution, it is appearing that name of husband of the petitioner is mentioned to be ‘Mahettar Yadav’ . However, in the cause title of writ petition filed before this Court bearing WP (C) No. 4395/2024, name of the petitioner’s husband is mentioned as “Late Chamru Yadav”. It appears that while drafting the writ petition, due to typographical mistake, inadvertently the name of husband of petitioner/applicant has been mentioned as ‘Late Shri Chamru Yadav” in place of “Late Mahettar Yadav”. Due to said mistake in cause title of WP (C) No. 4395/2024, the name of husband of the petitioner has been typed as “Shri Chamru Yadav” in the cause-title of the order dated 03.09.2024 passed in WP (C) No. 4395/2024. typographical and bona fide mistake for which, the petitioner should not be made to suffer.

Considering the fact that the name of the husband of the petitioner is erroneously mentioned in the cause-title of the writ petition, therefore, correction in the order passed in writ petition itself will not correct the details of the petitioner as mentioned in the writ petition. Hence, in the aforementioned facts of the case, it would be in the interest of justice to recall the order so that, the cause-title of the writ petition may be appropriately corrected by the counsel for the petitioner therein.

For the foregoing discussion and in the larger interest of justice, the review petition is allowed and the order impugned 03.09.2024 in WP (C) No. 4395/2024 is recalled and the writ petition is restored to its original number . A copy of this order be kept in the record of WP (C) No. 4395/2024 for ready reference.
