Instagram handle stating that he along with some organizers of Raipur are organizing a nude party and were sending invitations to girls and general public at large and were also promoting the same through Instagram. In the said post, they were inviting girls in the said party in an obscene condition which was to be organized in a Club at VIP Road, Raipur. In the said promotion post, there were obscene photographs of girls in the background and the same was being circulated on social media handles. During investigation, the said Instagram Id was traced by the police authorities and it was found that the same was operated by a mobile number bearing 9669782369 which was registered in the name of the present applicant, but the Instrangram Id was being operated by co-accused Harsh Agrawal. Upon further investigation, it was found that the co-accused Harsh Agrawal is the son of the present applicant and in connivance with the applicant, they were conducting the aforesaid nude party and were promoting it through various hotels, clubs and Instagram.

He submits that there is prima facie evidence available against the applicant for commission of the aforesaid offences as the mobile number from which, the offending Instagram Id was operated was registered in the name of applicant. He further submits that the investigation is pending and there are ample chances of collecting evidence against the applicant. Considering the seriousness of the offences, the risk of tampering with evidence, and the prima facie material collected, it is submitted that the bail application deserves to be dismissed.
