Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail as he is arrested in connection with Crime No. 609/2016 registered at Police Station – Balod, District Balod (C.G.) for the offence punishable under Sections 420/34, 467, 468, 471, 406 of IPC and Sections 3, 4 and 5 of Prize Chits and Money Circulation Schemes (Banning) Act.

Allegation against the applicant is that he being the Director of a financing company namely ‘ Micro Leasing & Funding Ltd.” has defrauded several persons in the name of doubling the amount, who have invested their money in the company since 2004, but no amount was returned even after maturity, thereafter on 03.07.2025, an FIR was registered against the applicant and he has been arrested on 05.09.2025.

Learned Sr. Advocate appearing for the applicant submits that the applicant is innocent and has been falsely implicated in the present case because the applicant has not played any part in the aforesaid criminal case. The present applicant has already resigned from the post on 13.05.2013 and since then he is no longer associated with the company nor has ever acted as Director or any other role in the said company. Learned Sr. counsel further submits the applicant has been arrested on the ground that he is the son of accused Durga Prasad Mishra. The applicant has not signed any document or cheques. Further, as per the final report, there is nothing on record to show any role of the applicant. Learned Sr. counsel also submits that other co-

accused persons have alrady been granted bail by this Court in MCRC Nos.5043/2022 and 5390/2022 vide order dated 14.07.2022 and 26.07.2022 respectively. Therefore, the present applicant may also be extended privilege of regular bail on the same set of evidence.

Learned State counsel, however, opposes the bail application.

Considering the totality of the facts and circumstances of the case and further considering the order dated 14.07.2022 and 26.07.2022 passed in MCRC Nos.5043/2022 and 5390/2022, granting regular bail to co-accused persons respectively, & further considering that the applicant is in jail since 05.09.2025 and that the trial may take some time, without commenting anything on merit of the case, I am inclined to release the applicant on regular bail.

Accordingly, the instant bail application is allowed.

It is directed that the Applicant shall be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- (Rs. One Lakh only) with one local surety in the like amount to the satisfaction of the Trial Court for his appearance before the said Court as and when directed.
