No. 22/2018 registered at Police Station – Ratanpur, District – Bilaspur (C.G.) for the offence punishable under Sections 420 read with section 34 of IPC and Sections 4, 5, 6 & 10 of Chhattisgarh Depositors Protection Act.

Allegation against the present applicant is that during his tenure as Director of PACL Company, payment of 8 policies to the tune of Rs.1,50,825/- was not made and being contacted by the complainant in Raipur office, no satisfactory assurance was given and it was stated that the inquiry of Company is being done by the State Government. Based on this, offence has been registered and the applicant has been arrested.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the crime in question. The name of the applicant does not find place in the FIR, as such no specific allegation is attributed against the applicant, and as per the charge sheet, the applicant is shown to be one of the Director of the Company. Learned counsel further submits that the applicant is in custody since 13.08.2021, and other similarly situated co-accused persons have been granted bail by this Court vide order dated 12.07.2022, 13.02.2023 and 15.06.2023 passed in MCRC Nos. 4410/2022, 588/2023 and 3519/2023, respectively. Therefore, the present applicant may also be extended privilege of regular bail on the same set of evidence.

Learned State counsel, however, opposes the bail application.

Learned State counsel submits that the applicant is one of the Director of the PACL company, therefore, he has been arrested in the case.

I have heard learned counsel for the parties and perused the material available on record.

Considering the totality of the facts and circumstances of the case and further considering the order dated 12.07.2022, 13.02.2023 and 15.06.2023 passed in MCRC Nos. 4410/2022, 588/2023 and 3519/2023 respectively, granting regular bail to other co-accused persons & also considering that the applicant is in jail since 13.08.2021, without commenting anything on merit of the case, I am inclined to release the applicant on regular bail.

Accordingly, the instant bail application is allowed.

It is directed that the Applicant shall be released on bail on his executing a personal bond for a sum of Rs.1,00,000/- with one local surety of the like amount to the satisfaction of the trial Court for his appearance before the said Court as and when directed.
