Vide order dated 26.09.2025, the victim was appeared along with her father and recorded ‘no objection’ in granting bail to the Applicants.

The applicants have preferred this 1^st bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita Act 2023 for grant of regular bail as they are arrested in connection with crime No. 51/2025, registered at Police Station – Sariya, District- Sarangarh-Bilaigarh (C.G.) for offence punishable under Sections 137(2)/49, 87/49, 64(2M)/49 of BNS and Section 6/17 of the POCSO Act, 2012.

There are total 5 accused persons in this case. The prosecution's case, in short, is that on 05.04.2025 co-accused Ayan Khan abducted the minor victim with the help of present applicants and one juvenile accused and taken her to Jharsuguda at another co-accused Salma Begum @ Rabo’s home where Ayan committed sexual intercourse with her. The allegation against the present applicants is that they allegedly assisted co-accused Ayan Khan in dropping the victim. Based on above, offence has been registered against the applicants.

Learned counsel for the applicant submits that the applicants are innocent and has been falsely implicated in the crime in question. The victim has examined before the Trial Court and she has not stated anything against the applicants. The parents of the victim have also been turned hostile. The main accused is Ayan Khan. The applicants have only assisted the co-accused in dropping the victim. The applicants are in jail since 10.04.2025, out of 22 prosecution witnesses only 5 have been examined till date and the trial is likely to take time to be finalized, therefore, it is prayed that the applicants may be enlarged on bail.

Per contra, learned Counsel appearing on behalf of the State opposes the bail application and submits that at the time of incident, the victim was minor and there was an involvement of the applicants in the crime in question, therefore, looking to the nature of offence, the applicants may not be released on bail.

I have heard learned Counsel appearing for the parties and perused the material available on record.

Considering the facts and circumstances of the case, evidence collected by the prosecution, detention period of the applicants, role played by them in the crime in question and the fact that as stated, out

of 22 prosecution witnesses only 5 have been examined till date and the trial is likely to take time to be finalized, without further commenting on merits of the case, I am inclined to release the applicants on bail.

Accordingly, the bail application is Allowed .

It is directed that the applicants shall be released on bail on executing a personal bond for a sum of Rs. 20,000/- each with one solvent surety for the like sum to the satisfaction of the Trial Court for their appearance before the said Court as and when directed.
