The applicant has filed this first bail application under Section 483 of B.N.S.S. for grant of regular bail as he is in custody since 30.06.2021 in connection with Crime No. 960/2016 registered at Police Station - Surajpur, District - Surajpur (CG) for the offence punishable under Sections 420 & 120B of the IPC, Sections 4, 5 & 6 of the Chit Fund Evam Dhan Parichalan Adhiniyam and Section 10 of the Chhattisgarh Protection of Depositor’s Interest Act.

Case of prosecution in brief is that on the applicant has committed offences punishable under Sections 420, 120 B of IPC, Sections 4, 5 & 6 of the Chit Fund Evam Dhan Parichalan Adhiniyam and Section 10 of the Chhattisgarh Protection of Depositor’s Interest Act. It is alleged that the company namely PACL allured different persons to deposit money in the account of the company with an assurance of doubling it in short period of time. Subsequently, same having not been done and the offence was registered wherein the applicant has been arrested and is in jail.

Learned counsel for the applicant submits that that total 18 cases have been registered against the present applicant and in the present case, co-accused Sikender Singh Dhillon has been granted bail by coordinate Bench of this Court on 07.11.2023 in MCRC No.6759 of 2023 and the case of the present applicant is similar to that of co- accused Sikender Singh Dhillon. Therefore, he prays for grant of bail to the applicant. He submits that the applicant is languishing in jail since 30.06.2021 and trial has not concluded as yet. Therefore, considering the aspect of the matter, the application may be allowed.

On the other hand, learned counsel for the State opposes the bail application.

I have heard learned counsel for the applicant and perused the case diary.

Be that as it may, considering the facts and circumstances of the case, considering the rival submissions made by counsel for parties, looking to the detention period i.e. 30.06.2021, evidence collected on record and trial is likely to take sometime and also co-accused has been granted bail by coordinate Bench of this Court, therefore, I am inclined to allow this bail application.

Let the Applicant- Sukhdev Singh , involved in Crime No. 96/2016 registered at Police Station Surajpur, District Surajpur, for the offences punishable under Sections 420 & 120B of the IPC, Sections 4, 5 & 6 of the Chit Fund Evam Dhan Parichalan Adhiniyam and Section 10 of the Chhattisgarh Protection of Depositor’s Interest Act, be released on bail on his furnishing a personal bond of Rs. 25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court on the condition that-

a) He shall appear before the trial Court regularly on each and every date, unless exempted from appearance.

b) He shall not make any attempt to tamper with the prosecution witnesses.

If any of the conditions is violated by the applicant, learned trial Court is at liberty to cancel the bail granted to the applicant.
