1 . This is the second bail application filed before this Court by the applicant under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail. The applicant has been arrested on 13-06-2024 in connection with Crime No.120/2024, registered at Police Station Bishrampur, District Surajpur, Chhattisgarh for the offence under Section 294, 506, 323, 450 and 302 of the IPC.

2 . Vide order dated 03-12-2024 passed in MCRC No.6854 of 2024 the first bail application of the applicant has been dismissed as withdrawn.

3 . Learned counsel for the applicant would submit that the applicant is in jail since 13-06-2024 and till date only three witnesses have been examined and the case will take its own time. The material witnesses have been examined.

Therefore, he has filed the present second bail application.

4 . On the other hand, learned counsel for the State opposes and has submitted that examination of the witnesses are going on and there is sufficient evidence against the applicant that he involved in the offence in question. Therefore, he is not entitled for bail.

Considering the submissions made by learned counsel for the parties, considering the nature of allegations and the material collected during the investigation and further that the first bail application of the applicant has been dismissed as withdrawn and examination of the witnesses are going on before the learned trial Court, I am not inclined to admit this second bail application as there is no change in circumstances after dismissal of the first bail application. Accordingly, the present second bail application filed by the applicant is dismissed at motion stage itself.

6 . Considering the fact that the applicant is in jail since 13-06-2024, the learned trial Court is expected to expedite the trial of the case.
