The appellant has filed the instant appeal under Section 13(i) (A) of the Hindu Marriage Act, 1955 against the impugned judgment & decree dated 04.12.2023 passed in Civil Case No. 03A/2022 by the learned Family Court, Rajnandgaon, District- Rajnandgaon (C.G.), whereby the

application under Section 13(i) (A) of the Hindu Marriage Act, 1955 which was filed by the appellant has been rejected.

During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 03.04.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on 09.04.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 09.04.2025, which was duly signed by them.

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicably resolved the dispute before the Mediation Centre of this Court and on the same day i.e., on 09.04.2025, both the parties have filed an application under Section 13-B of the Hindu Marriage Act, 1955 for mutual divorce and one application has been filed by both the parties for waiver of cooling period provided under Section 13-B of the Hindu Marriage Act, 1955, therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 09.04.2025.

We have heard learned counsel for the respective parties.

Under the circumstances with respect to the application filed by the petitioner and the respondent under Section 13-B of the Hindu Marriage Act, 1955 and looking to the submissions and conditions of the settlement deed dated 09.04.2025 we deem it proper to waive the cooling-off period of six months and pass a decree of divorce on mutual consent.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 09.04.2025, the present appeal is disposed of in terms of the said agreement. Consequently, the marriage between the parties got dissolved from today and the said agreement will form part of this judgment/decree.

It is ordered that the marriage dated 24.04.2012 between the parties is dissolved by decree of divorce under Section 13-B of the Hindu Marriage Act, 1955. No order as to costs.

Interlocutory application, if any pending, shall also stand disposed of.
