Matrimonial appeal under Section 13(1)(a) of the Hindu Marriage Act, 1955 against the judgment and decree dated 19.06.2023 of the Family Court, Rajnandgaon in Civil Suit No. 87A/2019, whereby the marriage between the parties was dissolved on the respondent's petition. During the pendency of the appeal the parties agreed to amicable settlement; vide order dated 16.01.2025 the matter was referred to the Mediation Centre of the High Court, and on 06.02.2025 they settled their dispute in terms of a settlement agreement dated 05.02.2025, signed voluntarily and without coercion. Terms recorded: respondent to pay appellant Rs. 6,70,000/- as one-time settlement through RTGS/NEFT within two months, in two instalments of Rs. 3,35,000/- each (first within six months, second thereafter, each before the Court); the minor daughter (about 7 years, studying in class 2) to reside with the mother, who retains custody, with visitation rights to the father; monthly maintenance of Rs. 3,000/- hitherto paid to the appellant to be converted into a fixed deposit, and Rs. 2,000/- per month for the daughter to continue; the pending execution case of Rs. 45,000/- before the Katghora court to be treated as merged in the settlement amount. The appellant has filed the instant appeal under Section 13 (1) (A) of the Hindu Marriage Act, 1955 against the impugned judgment & decree dated 19.06.2023 passed in Civil Suit No. 87A/2019 by the learned Family Court, Rajnandgaon, District- Rajnandgaon (C.G.), whereby the learned Family Court has passed the decree of divorce in favour of the respondent under Section 13 (1) (A) of the Hindu Marriage Act, 1955 and dissolved the

marriage between the parties. Therefore, the present appeal filed by the appellant.

During the pendency of appeal both the parties agreed for amicable settlement and vide order dated 16.01.2025, the matter was referred to Mediation Centre of this Court and both parties have settled their dispute before the Mediation Centre on 06.02.2025, wherein statements of both the parties got recorded and compromise was arrived at between the parties in terms of the settlement agreement dated 05.02.2025, which was duly signed by them.

The settlement agreement dated 05.02.2025 is as under:-

Learned counsel for the parties jointly submit that the aforesaid agreement has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicable resolved the dispute before the Mediation Centre of this Court and therefore, the present appeal may be disposed of in terms of the aforesaid agreement dated 05.02.2025.

In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 05.02.2025, the present appeal is disposed of in terms of the said agreement, the terms of the settlement agreement dated 05.02.2025, will form part of this

judgment/decree .
