As the parties in all the appeals are same i.e. husband, wife and daughter and in Mediation Centre, parties have entered into compromise and settled their dispute, therefore, all the appeals are being heard together and decided by this common judgment.

2. In FA(MAT) Nos.248 of 2024 and 144/2024- The appeal i.e. [FA(MAT)No.248 of 2024) has been preferred by the appellant/husband & appeal i.e. [FA(MAT) No.144 of 2024] has been preferred by the appellants (wife and daughter) against the judgment and decree dated 14.03.2024 passed by learned II Additional Principal Judge, Family Court, Bilaspur (C.G.) in Civil Suit No. 12A/2023 whereby the application under Section 20(3) of Hindu Adoption and maintenance Act, 1956 claiming expenses for marriage of respondent No.2/daughter was partly allowed by awarding Rs.3,00,000/- in her favour.

In FA(MAT) No.122 of 2024- This appeal has been preferred by the appellant/husband against the judgment and decree dated 08.09.2023 passed by learned Principal Judge, Family Court, Bilaspur (C.G.) in Civil Suit No. 168-A/2018 whereby the suit preferred by the husband for dissolution of marriage, has been dismissed.

During pendency of these appeals, parties along with their children were directed to appear before the Mediation Centre of this Court to explore the possibility of amicable settlement between them. After the mediation proceedings done between the parties, they have filed compromise deed dated 08.10.2025 and an application (I.A. No.05/2025) in FA(MAT) No. 122/2024.

Both the parties have filed application dated 09.10.2025 seeking mutual divorce in light of para 7 of settlement agreed by both the parties on 08.10.2025 with following prayers:-

“1. Aforementioned matter filed by the appellant challenging the judgment and decree dated 08-09-2023 passed by learned Principal Judge, Family Court Bilaspur in civil suit no. 168-A/2018, vide which divorce petition filed by the appellant/plaintiff has been dismissed.

Hon'ble Court was pleased to direct both the parties to appear before Mediation Centre of Chhattisgarh High Court Bilaspur to explore the scope of settlement if any, pursuant to which both the parties appeared before the Mediation Centre and finally reached on settlement accordingly both the parties agreed and executed the terms of settlement dated 08-10-2025. Original copy of settlement dated 08-10-2025 finalized and executed between parties before Mediation centre of Chhattisgarh High Court is part of proceedings that may kindly be perused while adjudicating this application.

Both the parties are agreed on the contents of settlement dated 08-10-2025 conducted, finalized and executed before Mediation Centre of Chhattisgarh High Court Bilaspur.

Both the parties have also agreed to get their marriage dissolved by presenting suitable application in terms of para 7 of settlement agreement dated 08-10-2025 entered and executed by both parties.

Accordingly, both the parties are submitting this application jointly seeking mutual divorce in light of agreed contents mentioned in para 7 of the settlement dated 08-10-2025 which is just and Bonafide prayer of both the parties.

Individual affidavit in support of this application of both the parties are being filed herewith.

It is therefore, most respectfully prayed that this Hon'ble Court may kindly be pleased to allow the application and thus the decree of mutual divorce may kindly be granted to both parties, in the interest of justice.”

Learned counsel for the parties jointly submit that the aforesaid agreement dated 08.10.2025 has been arrived at between the parties without any pressure or coercion, out of their own free will, whereby they have amicably resolved the dispute before the Mediation Centre of this Court and therefore, the appeals i.e. FA(MAT) Nos. 248/2024 and 144/2024 may be disposed of in terms of the aforesaid agreement dated 08.10.2025. They further prayed that in FA(MAT) No. 122/2024, a decree of mutual divorce may be passed in terms of application (I.A. No. 05/2025) dated 09.10.2025 filed by both the parties which is supported by affidavits of both the parties.

We have heard learned counsel for the respective parties.

10. It is pertinent to mention here that both the parties appeared before this Court along with their children. Wife and children admitted that as

per settlement deed dated 08.10.2025, amount of Rs.24 lacs has been

transferred by the husband in the account of wife and daughter.

11.In view of the submissions made by learned counsel for the parties and looking to the terms and conditions of their settlement agreement dated 08.10.2025, both the appeals i.e. FA(MAT) Nos. 144/2024 and 248/2024 stand disposed off in terms of compromise deed dated 08.10.2025. The terms of the settlement agreement dated 08.10.2025, will form part of this judgment/decree.

12. The appeal I.e. FA(MAT) No. 122/2024 is allowed. The impugned judgment dated 08.09.2023 passed in Civil Suit No. 168-A/2018 is set aside. Consequently, the marriage dated 21.02.2000 between the parties is dissolved on the ground of compromise dated 08.10.2025 arrived at between the parties. The application dated 09.10.2025 will also form part of this judgment/decree.

13. Let a decree be drawn up accordingly.

14. Interlocutory applications, if any pending, shall also stand disposed of.
