Heard Mr. Abhyuday Singh, learned counsel for the petitioner. Also heard Mr. Hariom Rai, learned Panel Lawyer, appearing for the State/respondents and Mr. Purendra Khicyhariya, learned counsel, appearing for respondent No.2.

The present petition has been filed by the petitioner under Section 482 of CrPC with the following prayers :

“It is, therefore, prayed that this Hon’ble Court

may kindly be pleased to quash the FIR no. 198/2022 dated 06.03.2022 registered by Respondent no.1 and also quash the order dated 11.02.2022, passed by Judicial Magistrate First Class, Durg in Case No. 939/2022, in the interest of justice.”

Learned counsel for the petitioner state he wants to withdraw the instant petition as the closure report has already been filed in present case.

In view of the same, the instant petition is dismissed as withdrawn leaving it open to the complainant of the case to take recourse to law, if aggrieved by the closure report.
