The present petition has been filed by the petitioner seeking following relief:

“a. That, this Hon'ble Court may kindly be pleased to quash the Special Criminal Case No.874/2021 "State of Chhattisgarh Vs Vijay Sharma and another" pending before the learned Special Judge under Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Kawardha, District - Kabirdham (C.G.).

b. That, this Hon'ble Court may kindly be pleased to pass an order restraining the special judge in further proceeding of the case as the proceeding in the case is abuse of process of law as the entire case is based on unauthorized investigation and influence of ruling party of the state.

c. That, this Hon'ble Court may kindly be pleased to pass an order whereby the police authorities / State may kindly be directed to pay each of the applicants a sum of Rs. 10,00,000/- as compensation for mental harassment by lodging

the FIR with malafide intention and investigation without having any authority under the law.”

Learned counsel for respondent No.1 / State submits that the matter has become infructuous as the petitioner has already been acquitted on 28.03.2024.
