1. Heard Mr. Vivek Kumar Shrivastava, learned counsel for the petitioner. Also heard Mr. Shailendra Sharma, learned Panel Lawyer, appearing for respondent No. 1/State.

2. The present petition has been filed by the petitioner with the following prayers:

“ a. A and/or an order in the nature of issue calling for records pertaining to case of petitioner from respondent concerned for perusal of this Hon’ble Court, if deem fit. b. A and/or an order in the nature of the issue quashing FIR (Annexure P/1) and charge-sheet, if filed during pendency of petition, in the peculiar factual matrix of the case and in the interest of justice.

c. Cost of the proceedings.

d. Any other directions that may be deemed fit and just in the facts & circumstances of case. ”

Learned counsel for the petitioner submits that though the present petition has been filed for quashing of the FIR, but in the present case, the charge-sheet has already been filed before the competent Court and the learned trial Court had already framed the charges against the petitioner, therefore, he prays that the present petition be dismissed as withdrawn with the liberty to challenge the same.

4. Prayer is allowed.

5. In view of the submission made by the learned counsel for the petitioner, the present petition is dismissed as withdrawn with the liberty to the petitioner to take recourse to law before the appropriate forum, if so advised.
