The present petition is filed under Section 528 of BNSS, 2023 for taking action against the petitioner.

Brief facts of the case is that the petitioner is a bus operator of Sai Kripa Tour and Travels and his buses run in different cities of C.G. The petitioner had applied for permit to operate his bus from Raigarh to Sheorinarayan route and in the same route one Rajkishore Singh and his son namely Abhishek Singh operates Vasudev Bus Service who made an objection on the application of the petitioner. The petitioner has sought information from the District Transport Officer, Raigarh that Fitness and Tax information of Vehicle no. CG 13 D 2511 belonging to Vasudev Bus Service. The DTO, Raigarh has provided information to the petitioner fthat the Fitness of said vehicle is valid upto 17.04.2022 and vehicle is insured upto 08.01.2021. The DTO, Raigarh issued a show cause notice to Abhishek Singh and asked him to conduct physical verification of his vehicle and during physical verification of vehicle no. CG 13 D 2511 it is found that the operator of Vasudev Bus Service has made forged and has changed the Chassis number, thereafter the DTO, Raigarh has passed the order that its registration and permit was suspended.

Learned counsel for the petitioner contended that the petitioner has made many complaints before the respondent authorities raising his grievance but till date no action has been taken by the respondent authorities. He therefore prays to allow this petition and take appropriate action on the complaints made by the petitioner, in the interest of justice.

already been taken by the respondent authorities, therefore, this petition deserves to be dismissed.

I have heard learned counsel for the respective parties and perused the record with utmost circumspection.

On perusal of record, it transpires that, the petitioner is a bus operator of Sai Kripa Tour and Travels and his buses run in different cities of C.G. The petitioner had applied for permit to operate his bus from Raigarh to Sheorinarayan route and in the same route one Rajkishore Singh and his son namely Abhishek Singh operates Vasudev Bus Service who made an objection on the application of the petitioner. Annexure P/2 itself reveals that respondent no. 3/ District Transport Officer, Raigarh (C.G.) has issued a show cause notice on 12.01.2024 to respondent no. 6/ Abhishek Singh alleging therein that on 08.01.2024 respondent no. 6 has made available the vehicle bearing no. CG 13 D 2511 whose physical verification was done by Transport Inspector where it was found the chassis no. of CG 13 D 2511 is 386518C07804781. But vehicle -4 software reveals that chassis no. of CG 13 D 2511 is 386515LSZ836188 and directed the respondent no. 6 to appear before respondent no.3 within 7 days and explain the aforesaid

allegation.

Thereafter, respondent no. 3 has passed an order whereby the registration certificate and the permit of vehicle no. CG 13 D 2511 was suspended by the authority. Therefore, the respondent authorities has already taken action regarding suspension of permit.

Accordingly, the present petition deserves to be and is hereby dismissed.
