अभिभयोजन मामला सं्ቌेप में इस ्ቚकार है बिक घटना बिदनांक-26/10/2006 को बिदन के करी* 10:00 जे ज अभिभयोक ् ी घर में थी, उसका पति� काम करने गया था �* करमू और सबिनयोाई अभिभयोक ् ी के घर आकर उसे ाजार जाने ोले, अभिभयोक ् ी उनके साथ मोटर सायकल से जशपुर ाजार आ गई और शाम लगभग 05:00 जे ज वे वापस गांव जाने के लिलए बिनकले �ो रास्�े में सबिनयोाई के हन के यहां ादरकोना में थोड़ी देर रूकने के प्ቐा� वहां से सारू1ीह पहुंचे और आंगनाड़ी के पास ቄኌस्थ� झोपड़ी में ैठे थे, वहां अभिभयु्ሹ अजय सोनी अपनी मोटर सायकल से आया, वहां पर चारो लोग शरा पीये, जिजस शरा को करमू ने जशपुर ाजार से खरीदा था । शरा पीने के दौरान महावीर यादव भी वहां पहुंच गया, उसे भी शरा बिपलाये । प्ቐा� में करमू �था सबिनयोाई अपने मोटर सायकल में जाने लगे �था अभिभयु्ሹ अजय ने अभिभयोक ् ी से कहा बिक वह ्ቇाम-केरे बिकनकेल �क जा रहा है उसे छोड़ देगा, � अभिभयोक ् ी उसके मोटर सायकल में *ैठ गई । सारू1ीह घाट चढ़ने के दौरान ीच रास्�े में चौक के पास मोटर सायकल को रोककर अपीलाथ:, अभिभयोक ् ी के साथ Oरपकड़ करने लगा । अभिभयोक ् ी के मना करने पर भी अपीलाथ: नहीं माना और पटककर जरन *लात्संग बिकया �था

ाम-केरे ले जाकर छोड़ बिदया । महजू नगेभिशया उसे केरे घाट �क पहुंचाया । उसके प्ቐा� करमू भी वहां आ गया और केरे घाट से उसे घर �क पहुंचाया । घर पहुंचने के प्ቐा� घटना पति� को �ायी �था दूसरे बिदन करमू और सबिनयोाई को �ायी । �बिय� खरा* होने �था कमर में दद@ होने के कार्ቓ घटना की रिरपोट@ बिदनाँक-02/11/2006 को थाने में दी । जिजसपर ्ቚथम सूचना प्ቔ ्ቚदश@ पी-7 दज@ बिकया गया । अनुमति� �था सहमति� उपरां� अभिभयोक ् ी का तिचबिकत्सकीय परी्ቌ्ቓ करवाया गया । घटनास्थल का मौका-नक्शा �ैयार बिकया गया । अभिभयोक ् ी से उसके पेटीकोट और जाति� ्ቚमा्ቓ प्ቔ की जब्�ी की गयी । अपीलाथ: का भी तिचबिकत्सकीय परी्ቌ्ቓ करवाया गया । अपीलाथ: से हीरो हो01ा मोटर सायकल की जब्�ी की गयी । 1ॉक्टर ्ቛारा अभिभयोक ् ी के परी्ቌ्ቓ के दौरान �ैयार स्लाई1 और जब्� पेटीकोट को रासायबिनक परी्ቌ्ቓ हे�ु ्ቚयोगशाला भेजा गया । साति्ቌयों के *यान लिलये गये । अपीलाथ: को बिगरफ्�ार बिकया गया । बिववेचनापू्ቓ@ कर अभिभयोगप्ቔ पेश बिकया गया ।

�था अभिभयोजन की ओर से अपने प्ቌ समथ@न में कुल-13 साति्ቌयों का परी्ቌ्ቓ 21 दस्�ावेज ्ቚदश@ तिचन्हांबिक� करवाये गये । Oारा-313 द01 ्ቚबि्ቅया संबिह�ा के �ह� *यान में अपीलाथ: ने अपने बिवपरी� साति्ቌयों के कथनों को इन्कार कर�े हुए स्वयं को बिनद{्ቧ होना *�ा�े हुए कहा है बिक उसे झूठा फंसाया गया है । अपीलाथ: ने *चाव में कुल-03 साति्ቌयों का परी्ቌ्ቓ करवाया है । उभयप्ቌ काे सुना जाकर बिवचार्ቓ न्यायालय ्ቛारा अपीलाथ: को इस बिन्ቓ@य की कቄኌ01का-1 के अनुसार दो्ቧजिस्ቍ कर दቄኌ01� बिकया गया है । जिजसे इस अपील में चुनौ�ी दी गई है ।

अभिभयोजन मामले के अनुसार अभिभयोक ् ी (अ०सा०-4) ने अपीलाथ: के बिवरू्ሾ अभिभयोजन मामले की पुबि~ अपने न्यायालयीन *यान में की है । अभिभयोजन साቌኚय में जो �थ्य आये हैं उनसे यह ቄኌस्थति� स्प~ है बिक अभिभयोक ् ी (अ०सा०-4) एक बिववाबिह� मबिहला होकर 04 *्ሴों की माँ है । घटना बिदनांक-26/10/2006 की

�ायी गयी है बिकन्�ु उसकी रिरपोट@ पुलिलस में बिदनांक-02/11/2006 अथा@�् करी 07 बिदन के बिवलम्* से लिलखवायी गई है । 1ॉक्टर ्ቦीम�ी पी०सी० ए्ሪा (अ०सा०-1) ने अभिभयोक ् ी का 1ॉक्टरी परी्ቌ्ቓ कर ्ቚति�वेदन ्ቚदश@ पी-1 देना

�ाया है । जिजसके अनुसार इस ा� कोई बिनति्ቐ� अभिभम� नहीं बिदया गया है बिक अभिभयोक ् ी के साथ जरन संभोग हुआ था । इस मामले में, 1ॉक्टर ्ቛारा सील*ंद कर दी गई स्लाई1 �था अन्य जब्� अं�रवኚᮌ वगैरह जो रासायबिनक परी्ቌ्ቓ हे�ु ्ቚ योगशाला को भेजे गये थे उसकी कोई परी्ቌ्ቓ रिरपोट@ ्ቚस्�ु� नहीं हुई है । ऐसी दशा में, अभिभयोक ् ी (अ०सा०-4) के साቌኚय का गहरायी से मूल्यांकन आवश्यक हो जा�ा है क्योंबिक अपीलाथ: के बिवरू्ሾ अभिभयोजन का मामला अभिभयोक ् ी (अ०सा०-4) के साቌኚय पर ही आOारिर� है ।

न्यायदृां� Santosh Prasad @ Santosh Kumar v. State of Bihar, (2020) 3 SCC 443 में माननीय उ्ሴ�म न्यायालय ्ቛारा अवOारिर� बिकया गया है बिक लात्कार के अपराO में एकमा्ቔ पीबिड़�ा के कथन पर भी दो्ቧजिसति्ቍ की जा सक�ी है बिकन्�ु यह � होना चाबिहए ज* पीबिड़�ा का *यान बिव्ቫास पैदा करें �था पूरी �रह से बिव्ቫसनीय, *ेदाग और उत्कृ गु्ቓव्ቈा का ्ቚ�ी� हो । जिजसके सं*ंO में कቄኌ01का-5.4.3, 5.5 एवं 6 में बिनम्नानुसार अवOारिर� बिकया गया है:-

“5.4.3. In Krishan Kumar Malik v. State of Haryana (2011) 7 SCC 130 it is observed and held by this Court that no doubt, it is true that to hold an accused guilty for commission of an offence of rape, the solitary evidence of the prosecutrix is sufficient provided the same inspires confidence and appears to be absolutely trustworthy, unblemished and should be of sterling quality.

5.5 With the aforesaid decisions in mind, it is required to

be considered, whether is it safe to convict the accused solely on the solitary evidence of the prosecutrix? Whether the evidence of the prosecutrix inspires confidence and appears to be absolutely trustworthy, unblemished and is of sterling quality?”

Having gone through and considered the deposition of the prosecutrix, we find that there are material contradictions. Not only there are material contradictions, but even the manner in which the alleged incident has taken place as per the version of the prosecutrix is not believable. In the examination-in-chief, the prosecutrix has stated that after jumping the fallen compound wall accused came inside and thereafter the accused committed rape. She has stated that she identified the accused from the light of the mobile. However, no mobile is recovered. Even nothing is on record that there was a broken compound wall. She has further stated that in the morning at 10 O’clock she went to the police station and gave oral complaint. However, according to the investigating officer a written complaint was given. It is also required to be noted that even the FIR is registered at 4:00 p.m. In her deposition, the prosecutrix has referred to the name of Shanti Devi, PW1 and others. However, Shanti Devi has not supported the case of the prosecution. Therefore, when we tested the version of PW5prosecutrix, it is unfortunate that the said witness has failed to pass any of the tests of “sterling witness”. There is a variation in her version about giving the complaint. There is a delay in the FIR. The medical report does not support the case of the prosecution. FSL report also does not support the case of the prosecution. As admitted, there was an enmity/dispute between both the parties with respect to land. The manner in which the occurrence is stated to have occurred is not believable. Therefore, in the facts and circumstances of the case, we find that the solitary version of the prosecutrix-PW5 cannot be taken as a gospel truth at face value and in the absence of any other supporting evidence, there is no scope to sustain the conviction and sentence imposed on the appellant and accused is to be given the benefit of doubt.”

माननीय उ्ሴ�म न्यायालय ्ቛारा अभिभव्य्ሹ बिकया गया है बिक जहाँ, अभिभयोक ् ी ही एक ्ቚमुख सा्ቌी हो वहाँ उसकी साቌኚय की समी्ቌा सूቌኚम�ापूव@क होनी चाबिहए । इस सं*ंO में, माननीय उ्ሴ�म न्यायालय ्ቛारा न्यायदृ~ां� Raju and others v. State of Madhya Pradesh (2008) 15 SCC 133 की कቄኌ01का-11 व 12 में बिनम्नव�् अभिभव्यबि्ሹ दी हैः-

“11. It cannot be lost sight of that rape causes the greatest distress and humiliation to the victim but at the same time a false allegation of rape can cause equal distress, humiliation and damage to the accused as well. The accused must also be protected against the possibility of false implication, particularly where a large number of accused are involved. It must, further, be borne in mind that the broad principle is that an injured witness was present at the time when the incident happened and that ordinarily such a witness would not tell a lie as to the actual assailants, but there is no presumption or any basis for assuming that the statement of such a witness is always correct or without any embellishment or exaggeration.

Reference has been made in Gurmit Singh case [(1996) 2 SCC 384 : 1996 SCC (Cri) 316] to the amendments in 1983 to Sections 375 and 376 of the India Penal Code making the penal provisions relating to rape more stringent, and also to Section 114-A of the Evidence Act with respect to a presumption to be raised with regard to allegations of consensual sex in a case of alleged rape. It is however significant that Sections 113-A and 113-B too were inserted in the Evidence Act by the same amendment by which certain presumptions in cases of abatement of suicide and dowry death have been raised against the accused. These two sections, thus, raise a clear presumption in favour of the prosecution but no similar presumption with respect to rape is visualised as the presumption under Section 114-A is extremely restricted in its applicability. This clearly shows that insofar as allegations of rape are concerned, the evidence of a prosecutrix must be examined as that of an

injured witness whose presence at the spot is probable but it can never be presumed that her statement should, without exception, be taken as the gospel truth. Additionally, her statement can, at best, be adjudged on the principle that ordinarily no injured witness would tell a lie or implicate a person falsely. We believe that it is under these principles that this case, and others such as this one, need to be examined. ”

इसी �रह, माननीय उ्ሴ�म न्यायालय ्ቛारा न्यायदृ~ां� Rai Sandeep alias

Deepu v. State (NCT of Delhi), (2012) 8 SCC 21 की कቄኌ01का-22 में बिनम्नव�् अभिभव्यबि्ሹ दी हैः-

“22. In our considered opinion, the “sterling witness” should be of a very high quality and caliber whose version should, therefore, be unassailable. The Court considering the version of such witness should be in a position to accept it for its face value without any hesitation. To test the quality of such a witness, the status of the witness would be immaterial and what would be relevant is the truthfulness of the statement made by such a witness. What would be more relevant would be the consistency of the statement right from the starting point till the end, namely, at the time when the witness makes the initial statement and ultimately before the Court. It should be natural and consistent with the case of the prosecution qua the accused. There should not be any prevarication in the version of such a witness. The witness should be in a position to withstand the cross-examination of any length and howsoever strenuous it may be and under no circumstance should give room for any doubt as to the factum of the occurrence, the persons involved, as well as, the sequence of it. Such a version should have co-relation with each and every one of other supporting material such as the recoveries made, the weapons used, the manner of offence committed, the scientific evidence and the expert opinion. The said version should consistently match with the version of every other witness. It can even be stated that it should be akin to the test applied in the case of circumstantial evidence where there should not be any missing link in the chain of circumstances to hold the accused guilty of the offence alleged against him. Only if the version of such a witness qualifies the above test as well as all other similar such tests to be applied, it can be

held that such a witness can be called as a “sterling witness” whose version can be accepted by the court without any corroboration and based on which the guilty can be punished. To be more precise, the version of the said witness on the core spectrum of the crime should remain intact while all other attendant materials, namely, oral, documentary and material objects should match the said version in material particulars in order to enable the Court trying the offence to rely on the core version to sieve the other supporting materials for holding the offender guilty of the charge alleged.”

अभिभयोक ् ी (अ०सा०-4), करमू राम नाग (अ०सा०-3), ्ቦीम�ी सबिनयोाई उरांव (अ०सा०-7) और रूपन दास (अ०सा०-10) के यान से यह ቄኌस्थति� स्प~ है बिक घटना के बिदन करमू (अ०सा०-3) मोटर सायकल में अभिभयोक ् ी (अ०सा०-4) और सबिनयोाई (अ०सा०-7) को जशपुर ाजार घूमाने लेकर गया था । वे �ीनों ही रास्�े में शरा का सेवन बिकये थे । उन्होंने दो ार शरा का सेवन बिकया था । वापसी के समय रूपन दास (अ०सा०-10) के घर रूके थे । उसके प्ቐा� एक मोटर सायकल में करमू (अ०सा०-3), सबिनयोाई (अ०सा०7) को लेकर वापस चला गया था । अभिभयोजन मामले के अनुसार एक व्यबि्ሹ जो अपीलाथ:/अभिभयु्ሹ था वह मोटर सायकल में आ रहा था �* करमू (अ०सा०-3) के कहने पर अभिभयोक ् ी (अ०सा०-4) उस व्यबि्ሹ के मोटर सायकल में *ैठी थी जो व्यबि्ሹ अभिभयोक ् ी के साथ सारू1ीह घाट में *लात्संग बिकया । *लात्संग करने वाले व्यबि्ሹ की भिशनाख्� को अपीलाथ: प्ቌ ्ቛारा चुनौ�ी दी गई है । स्वयं अभिभयोक ् ी (अ०सा०-4) ने यह कहा है बिक घटना के समय वह तिच्ቤायी थी और दो व्यबि्ሹ आवाज सुनकर आये थे, उन दो व्यबि्ሹयों का नाम महेन ् और बिवजय उफ@ घुरा *�ायी है । बिकन्�ु अभिभयोजन की ओर से इन दोनों ही व्यबि्ሹयों का परी्ቌ्ቓ

नहीं हुआ है । अभिभयोक ् ी (अ०सा०-4) के ्ቛारा लिलखवायी गई रिरपोट@ ्ቚदश@ पी-7 �था उसके पुलिलस *यान ्ቚदश@ 1ी-1 में भी अभिभयोक ् ी ्ቛारा तिच्ቤाये जाने की *ा� का उ्ቤेख नहीं है । अभिभयोक ् ी (अ०सा०-4) ने यह भी कहा है बिक पास में ही महजू (रिरश्�े के ससुर) बिनवास कर�े हैं जिजन्हें वह जाकर घटना *�ायी थी बिकन्�ु अभिभयोजन की ओर से कभिथ� महजू (रिरश्�े में ससुर) का भी परी्ቌ्ቓ नहीं करवाया गया है । इस �रह से, जो ्ቚमुख सा्ቌी हो सक�े थे उनमें से अभिभयोजन ्ቛ ारा बिकसी का परी्ቌ्ቓ नहीं करवाया गया है ।

अभिभयोक ् ी (अ०सा०-4) ने स्वयं अपने न्यायालयीन *यान में कहा है बिक वह अपीलाथ: को घटना से पहले कभी ना �ो देखी थी और ना ही जान�ी थी *ቄኌल्क उसका नाम उसे करमू (अ०सा०-3) ने *�ाया था । अभिभयोक ् ी (अ०सा०-4) ने यह भी कहा है बिक कभिथ� *लात्संग की घटना के समय उसने घटना कारिर� करने वाले व्यबि्ሹ को मोटे रूप से पहचाना था, प्ሪे रूप से नहीं पहचाना था । इस ्ቚकार से, अपराOी की पहचान संदेहास्पद हो गई है । अभिभयोक ् ी (अ०सा०-4) ने ्ቚ ति�परी्ቌ्ቓ में यह भी कहा है बिक वे सारू1ीह में जहां ैठे थे वहां बिजली नहीं थी और अंOेरा था । प्ቐा� में स्व�ः कह�ी है बिक वहां बिम्ሾी की बि©*री जल रही थी जिजसमें उसने सारू1ीह के रूपन दास (अ०सा०-10) के परिरजनों का चेहरा देखा था । बिकन्�ु आगे वह यह भी स्वीकार कर�ी है बिक दो ार शरा का सेवन करने से वह पूरी �रह से होश में नहीं थी । उसने यह भी स्वीकार बिकया है बिक न्यायालयीन *यान के समय भी उसके समाज के काफी लोग न्यायालय में उसके साथ आये थे । उसने यह भी स्वीकार बिकया है बिक घटना के प्ቐा� समाज के लोगों का �था उसके पति� का बिवचार था बिक बिकसी भी हाला� में अपीलीथ: को सजा होनी चाबिहए और

उनके यहां समाज में ्ቚति�बिदन *ैठकें चल�ी थी बिक मुकदमे को कैसे लड़ना है । उसने यह भी स्वीकार बिकया है बिक उसे *�ाया गया था बिक यबिद अपीलाथ: को सजा होगी �ो उसे शासन से 1,00,000/-रूपये की ्ቌति�पूቔኌ� बिमलेगी । उसने यह भी स्वीकार बिकया है बिक यबिद, करमू (अ०सा०-3) ्ቛारा अपीलाथ: की पहचान नहीं *�ायी जा�ी �ो वह अपीलाथ: को नहीं पहचान पा�ी । इस ्ቚकार से, अपीलाथ: की पहचान पू्ቓ@�ः संबिदग्O रही है ।

अभिभयोक ् ी (अ०सा०-4) ने जिजस ्ቚमुख सा्ቌी करमू (अ०सा०-3) का उ्ቤेख बिकया है, उस करमू ने अपने न्यायालयीन यान में अभिभयोजन मामले के अनुसार इस �थ्य की पुबि~ नहीं की है बिक प्ቐा� में ज वह, मोटर सायकल लेकर अभिभयोक ् ी को लेने पहुंचा और उसे मोटर सायकल में लेकर आ रहा था �* अभिभयोक ् ी ने उसे अपीलाथ: ्ቛारा *लात्संग बिकये जाने की *ा� �ायी रही हो । इस �रह, इस िሮदु पर करमू प्ቌ्ቖ ोही हो गया है बिक अभिभयोक ् ी ने उसे अपीलाथ: ्ቛ ारा उसके साथ लात्संग बिकये जाने की ा� उस रा� �ायी हो । इसी ्ቚकार से, करमू ने ्ቚति�परी्ቌ्ቓ की कቄኌ01का-18 में यह भी कहा है बिक उस बिदन ज वे रूपन दास (अ०सा०-10) के यहां शरा पीये थे � बिवचार्ቓीय अपीलाथ: ना �ो ्ቇ ाम-सारू1ीह में मोटर सायकल लेकर पहुंचा था और ना ही वह अभिभयोक ् ी (अ०सा०-4) को *ैठाकर ्ቇाम-केरे बिकनकेल के लिलए बिनकला था । इस �रह से, करमू (अ०सा०-3) ने अपीलाथ: के उस बिदन ्ቇाम-सारू1ीह पहुंचने की *ा� को भी इन्कार कर बिदया है । चूंबिक, अभिभयोक ् ी (अ०सा०-4) का *यान करमू (अ०सा०-3) ्ቛारा अपीलाथ: के नाम की दी गई जानकारी पर आOारिर� है और करमू ही प्ቌ्ቖ ोही हो गया है । ऐसी दशा में, अभिभयोक ् ी (अ०सा०-4) का यह

*यान संदेहास्पद पाया जा�ा बिक घटना के बिदन अपीलाथ: के साथ वह मोटर सायकल में *ैठी थी और अपीलाथ: ने उसके साथ *लात्संग बिकया हो ।

दूसरी ्ቚमुख सा्ቌी ्ቦीम�ी साबिनयो*ाई उरांव (अ०सा०-7) है । उसने भी मोटर सायकल में *ाजार जाने आबिद �थ्यों की पुबि~ की है बिकन्�ु करमू (अ०सा०-3) के अनुसार वह भी इस �थ्य की पुबि~ नहीं कर�ी है बिक अभिभयोक ् ी (अ०सा०-4) ने उसे अपीलाथ: ्ቛारा लात्संग बिकये जाने की ा� की जानकारी दी रही हो । इस िሮदु पर वह भी प्ቌ्ቖ ोही हो गई है और ्ቚति�परी्ቌ्ቓ में कही है बिक जो व्यबि्ሹ ्ቇाम सारू1ीह में मोटर सायकल में आया था, वह अपीलाथ: नहीं था । इस ्ቚकार, अपीलाथ: की अपराOी के रूप में पहचान की पुबि~ साबिनयोाई ने भी नहीं की है । इसलिलए भी अभिभयोक ् ी (अ०सा०-4) का यह *यान संदेहास्पद हो जा�ा है बिक उस बिदन अपीलाथ: ने उसके साथ बिकसी ्ቚकार से *लात्संग बिकया रहा हो ।

रूपन दास (अ०सा०-10) के घर उस बिदन पहुंचने वालों में महावीर यादव (अ०सा०-8) भी एक सा्ቌी �ाया गया है । जिजसने इस �थ्य की पुबि~ �ो की है बिक रूपन दास के यहां करमू आया था जिजसके साथ दो लड़बिकयां थी । बिकन्�ु उन लड़बिकयां को पहचान पाने में असमथ@�ा व्यबि्ሹ की है और कहा है बिक ज वह रूपन दास के यहां गया था �* वहां अपीलाथ: नहीं था । इस �रह, मौके पर अपीलाथ: की उपቄኌस्थति� को इस सा्ቌी ने भी पु~ नहीं बिकया है ।

घटना बिदनांक-26/10/2006 की है जिजसकी रिरपोट@ पुलिलस में बिदनांक-02/11/ 2006 को लिलखवायी गई है । करी* एक स्቎ाह के बिवलम्* का कार्ቓ यह उ्ቤेलिख� बिकया गया है बिक अभिभयोक ् ी (अ०सा०-4) के कमर में दद@ था । इस ा� कोई

भी तिचबिकत्सकीय साቌኚय पेश नहीं की गई है । अभिभयोक ् ी ने कहा है बिक उसने घटना की ही रा� अपने पति� (अ०सा०-5) को घटना की जानकारी दे दी थी बिकन्�ु उसी बिदन रिरपोट@ क्यों नहीं लिलखवायी गई, इस बिव्ቧय में पति� (अ०सा०-5) का *यान समाOान्ቚद नहीं है । पति� (अ०सा०-5) ने कहा है बिक वे पुलिलस में रिरपोट@ करने जा�े थे, बिकन्� ु उनकी रिरपोट@ लिलखी नहीं जा�ी थी �था उन्हें *ार-ार थाने ुलाया जाने लगा । जबिक बिववेचक के रूप में सहायक उपबिनरी्ቌक लቌኚम्ቓ राम कुलदीप (अ०सा०-9) ने कहा है बिक रिरपोट@ बिदनांक-02/11/2006 के पूव@ अभिभयोक ् ी या उसके पति� में से कोई भी रिरपोट@ करने जिसटी को�वाली नहीं आये थे । इस ्ቚकार से, एक स्቎ाह के बिवलम् से रिरपोट@ लिलखवाये जाने का समाOान्ቚद स्प~ीकर्ቓ अभिभयोजन की ओर से नहीं आया है । जो कार्ቓ अभिभयोजन की ओर से *�ाया जा रहा है वह आपस में अं�रबिवरोO लिलये हुए हैं । स्वयं अभिभयोक ् ी ने यह स्वीकार बिकया है बिक उनके समाज वालों की *ैठकें हो�ी थी और उसमें यह �य बिकया जा�ा था बिक बिकस �रह से मामले को लड़ना है और अपीलाथ: को सजा बिदलवाया जाना है । उसके मन मቄኌस्�ष्क में यह *ा� भी 1ाली गई थी बिक यबिद अपीलाथ: को सजा हो�ी है �ो उसे शासन की ओर से ्ቌति�पूቔኌ� के रूप में 1,00,000/-रूपये बिमलेगा ।

इन स* �थ्यों को दृबिग� रख�े हुए ज* स्वयं अभिभयोक ् ी (अ०सा०-4) के साथी के रूप में करमू (अ०सा०-3) और साबिनयो*ाई (अ०सा०-7) ने इस �थ्य की पुबि नहीं की है बिक घटना के रा� ही अभिभयोक ् ी ने अपने साथ *लात्संग बिकये जाने की जानकारी दी हो और कभिथ� *लात्संग बिकये जाने वाले अपराOी के रूप में अपीलाथ: की भिशनाख्� भी पू्ቓ@�ः संदेहास्पद है । ऐसी दशा में, न्यायदृ~ां�ों के

काश में अभिभयोक ् ी (अ०सा०-4) का *यान संदेह से परे बिव्ቫसनीय नहीं पाया जा�ा । अपीलाथ: की दो्ቧजिसति्ቍ स्प~, पया@्቎ और बिव्ቫसनीय साቌኚय पर आOारिर� नहीं है । अपीलाथ: के बिवरू्ሾ अभिभयोजन अपना मामला संदेह से परे ्ቚमाभि्ቓ� करने में असफल रहा है । इसलिलए “ ाOीन बिन्ቓ@य ” ቄኌस्थर रखे जाने योग्य नहीं पाया जा�ा ।

अ�ः अपील सवीकार ् की जा�ी है । “ ाOीन बिन्ቓ@य ” अपास्� बिकया जा�ा है �था अपीलाथ: को संदेह का लाभ दे�े हुए आरोबिप� अपराO से दो् ቧ मु् ሹ बिकया जा�ा है ।

अपीलाथ: को जमान� पर *�ाया गया है । द01 ्ቚबि्ቅया संबिह�ा, 1973 की Oारा-437 ’क’ के �ह� उसका जमान�-मुचलका और 06 माह के लिलए ्ቚ भावशील रहेगा �त्प्ቐा�् अन्य न्यायालय में उपቄኌस्थ� होने की आवश्यक�ा ना

रहने पर मु्ሹ समझा जायेगा ।

बिन्ቓ@य की ्ቚति� के साथ बिवचार्ቓ न्यायालय को मूल अभिभलेख आवश्यक काय@वाही हे�ु सूचनाथ@ एवं पालनाथ@ शी्ቈ�ापूव@क ्ቚेबि्ቧ� हो ।
