Criminal Appeal (CRA No. 102 of 2020), High Court of Chhattisgarh at Bilaspur, decided 24/03/2025 by Ravindra Kumar Agrawal, J. — Appeal against judgment dated 07.01.2020 of the Upper Sessions Judge, Ramanujganj (Sessions Case No. 15/2018) convicting the appellant under S.450, S.376(2)(j) and S.506 Part-II IPC and sentencing him to rigorous imprisonment of 10 years with fine of Rs.1,000/- under each of S.450 and S.376(2)(j) (default additional R.I. 3 months) and 2 years with fine of Rs.500/- under S.506 Part-II (default additional R.I. 1 month), sentences concurrent. Prosecution case: on 09.11.2017 the appellant entered the house of a seven-months-pregnant married woman residing at her Bua's house in village Ucharwa, dragged her inside when she said she had no tobacco, and raped her, threatening her with dire consequences; FIR (Ex.P-6) under Ss.294, 506, 376(2)(n) and 450 IPC. Medical evidence (PW-3 Dr. Kamini Rai): pregnancy about 28 weeks, no external injuries; FSL report (Ex.P-18): semen and sperm on the petticoat, none on the vaginal slides. PW-2, PW-4 and PW-8 deposed that the appellant, initially absent, came to the village meeting the next morning and confessed his guilt, whereupon the members advised lodging the report. Held: the fact of rape stands duly proved from the victim's evidence; the defence plea of false implication on account of a money/property dispute (Rs.1,200/- said to be outstanding from the maternal uncle) was unsupported by clinching evidence — the defence witnesses disclosed no specific date, time or nature of the dispute — and a mere assertion of such dispute cannot discard the evidence of the victim and other witnesses; the trial Court's appreciation of evidence was proper and there was no sufficient ground to upset its well-reasoned findings. Appeal dismissed; appellant to serve the entire sentence; Registry directed to send a copy of the judgment to the concerned Superintendent of Jail, informing the appellant of his liberty to assail the judgment before the Supreme Court with the assistance of the High Court Legal Services Committee or the Supreme Court Legal Services Committee.
