The instant contempt petition has been filed alleging noncompliance of the order dated 11/11/2024 passed by this Court in WPC No.5598/2024 whereby the Respondent No.2, therein was directed to consider and decide the representation of the petitioner dated 30/08/2024 within a period of 30 days.

Learned counsel for the petitioner would submit that after the order passed by this Court, the petitioner has submitted a representation and apprised the authorities about the order passed by this Court,

however, till date the representation of the petitioner has not been decided.

Per contra, learned counsel for the respondent would submit that the order passed by this Court has already been decided by this Court and after giving due opportunity of hearing to the petitioner the order has been passed on 31/01/2025, meaning thereby the representation of the petitioner was decided. Thereafter, the said order has been challenged by one Sushil Kumar Shukla in WPC No.819 of 2025, wherein the order dated 31/01/2025 has been quashed.

I have heard learned counsel for the parties at length and perused the documents with utmost circumspection.

On perusal of the order I have found that the order passed by this Court has already been complied with and in compliance of the order passed by this Court the respondents have passed the order dated 31/01/2025 and the said order has been challenged by one Sushil Shukla in WPC No.819 of 2025 and in the said writ petition this Court has quashed the order dated 31/01/2025 and has passed the following order:-

For the forgoing reasons, the impugned order dated 31/01/2025 (Annexure P/1) deserves to be and is hereby quashed. The writ petition is allowed. However, the Municipal Corporation is at liberty to issue a fresh show cause notice by

providing sufficient opportunity of hearing to all the parties as well as to the respondent No.4 and pass a detailed order in accordance with law, if so desired.

From perusal of the aforesaid order it is crystal clear that the fresh order has been passed by the co-ordinate Bench in WPC No.819 of 2025 on 07/02/2025 and the petitioner has not filed the instant contempt petition against the order dated 07/02/2025. In view of this the instant contempt petition is dismissed and the contempt

proceedings against the contemnor is closed.
