1. This petition has been filed challenging the appellate order

dated 15.02.2016 (Annexure P/1) passed by the Commissioner Surguja Division, at Ambikapur, District Surguja (C.G), whereby, the appeal filed by respondent No.7 was allowed and the order dated 13.05.2014 (Annexure P/2) passed by the Collector, Surajpur was set aside and respondent No.7 was appointed as Anganbadi Center, Village- Kandarai, Newardand- 2.

2. At the outset, learned counsel for the petitioner would submit that this writ petition has been filed directly before this Court. He submits that against the appellate order, a remedy of revision lies under Chhattisgarh Panchayat Raj Adhiniyam, 1993. Hence, she seeks permission of the Court to withdraw this petition with liberty to file a revision before the competent authority. She also prays for a direction to the competent authority to pass a speaking order on the said revision, without taking any technical objection on the ground of delay and laches.

3. Learned counsel for the respondents would not oppose the said limited prayer.

In view of the aforesaid submissions, this writ petition is disposed of with a liberty to the petitioner to file a revision before the competent authority within a period of 45 days from the date of receipt of a copy of this order and in turn, it is expected from the revisional authority to decide the revision on merits without taking any technical objection on the ground of delay and laches. It is also directed that the revisional authority shall decide the revision in an expeditious manner preferably

within a period of four months from the date of filing of revision.

5. Certified copy of the impugned order be returned to learned counsel for the petitioner after retaining a photocopy of the same.
