Heard Mr. Gagan Tiwari, learned counsel for the petitioner as well as Mr. Ranbir Singh Marhas, learned Additional Advocate General, appearing for respondent No.1/State.

The present writ petition styled as ‘Public Interest Litigation’ under Article 226 of the Constitution of India has been filed by the petitioner seeking following reliefs :

“1] That, this Hon’ble Court may kindly be pleased to issue appropriate writ/direct to the respondents to implement Section 29(2)(f) of the Right of Children to Free and Compulsory Education Act, 2009 in letter and spirit by having Chhattisgarhi as medium of instruction in the schools in the state of Chhattisgarh.

2] That, this Hon’ble Court may be pleased to issue appropriate writ/direct the respondents to implement the National Education Policy 2020 issued by the Ministry of Human Resources Development, Government of India so far it relates to having medium of instruction in school education in Local Language i.e. Chhattisgarhi in the state of Chhattisgarh.

3] That, this Hon’ble Court may be pleased to issue appropriate writ/direct the respondents to implement the National Education Policy 2020 issued by the Ministry of Human Resources Development, Government of India by making available high quality text books in all School subjects in Chhattisgarhi language.

4] Any other relief, which this Hon’ble Court deems fit according to the facts & circumstances of the case may also be granted.”

Mr. Ranbir Singh Marhas, learned Additional Advocate General, appearing for the State/respondent No.1 states that the State Council of Educational Research & Training, Chhattisgarh has issued a letter dated 22.03.2024 to the Officer in Charge and Joint Director, Division Raipur, Chhattisgarh regarding giving information about the action taken so far to include ‘Chhattisgarhi language’ as a medium in schools. The operative portions of the said letter reads as follows :

“1. छत्तीसगढ़ीकोस्कूलशि�क्षापाठ्यक्रममेंपहलेसेही�ामिमलमिकयागया है।शि�क्षासत्र 2020-21 सेप्राथमिमकस्तर (कक्षा 1 तथाकक्षा 2 की) की पाठ्यपुस्तक n~मि"भामि$करूपमें�ामिमलकीगईहैं।छत्तीसगढ़ीकेअला"ा शि�क्षासत्र 2020-21 सेहीप्राथमिमकस्तरपरकक्षा 1 और 2 कीद‌मि"भामि$क पाठ्यपुस्तके 16 स्थानीय Hkk"kk-बोलिलयों (छत्तीसगढ़ी (रायपुरऔरमिबलासपुर संभाग), हल्दी, गोंडी (कांकेर, narsokM+k " बस्तर), भतरी, dqMq[k, सरगुजि4हा, सादरी, कमारी, बैगानी, दोरली, धुर"ी, बघेलीतथामाडिडयामें) �ामिमलकीगईहैं।

कक्षा 3 सेकक्षा 5 तककीहिंहदीभा$ाकीपाठ्यपुस्तकोंमेंछतीसगढ़ी Hkk"kk की 25 प्रडित�तपाठ्य-सामग्री�ामिमलकीगयीहै।कक्षा 6 से 8 तक कीहिंहदीभा$ाकीपाठ्यपुस्तकोंमेंभीछतीसगढीभा$ाकी 30 प्रडित�त पाठ्यसामग्री�ामिमलकीगईहै।इसीतरहकक्षा 9 से 10 तककीहिंहदीभा$ा कीपाठ्यपुस्तकोंमेंभीछत्तीसगढ़ीभा$ाकी 15 प्रडित�तपाठ्यसामग्री ” �ामिमलकीगईहै।

We have perused the aforesaid letter and its content and gone through the prayers and pleadings made in the instant writ petition. The aforesaid letter is taken on record.

Learned State counsel is directed to supply a copy of the said letter to counsel for the petitioner.

In the light of aforesaid letter dated 22.03.2024 issued by the State Council of Educational Research & Training, Chhattisgarh, the instant PIL stands disposed of .
