2. This petition has been preferred by the petitioner under Article 226 of the

Constitution of India, seeking following reliefs:-

“i) That, this Hon’ble Court may kindly be pleased to direct the respondent No.2 & 3 to take action on the application dated 25.10.2024.

ii) That, this Hon’ble Court may kindly be pleased to direct the respondent No.2 & 3 to take action against the respondent No.6 & 7.

iii) That, this Hon’ble Court may kindly be pleased to direct the respondent No.2 & 3 that, they will direct the respondent No.6 to prepared the voter list of the Gram Panchayat – Patora as previous year as directed by the state government vide letter dated 09.09.2024.

iv) That, any other relief which this Hon’ble Court deems fit and proper may also kindly be granted to the petitioner in the interest of justice along with cost of the petition. ”

Learned counsel for the petitioner would submit that local body election is going to be held in near future, but without any authority or order of the State Government or its instrumentality, respondent No.6, who is Secretary of Gram Panchayat, is deleting and adding the name of various voters in voter list of Gram Panchayat Patora, Tehsil Lundra from one ward to another ward. He would further submit that the petitioner is a Sarpanch of Gram Panchayat Patora, Tehsil Lundra, District Surguja (C.G.), therefore, she has filed representation/application (Annexure-P/3) dated 25.10.2024 before the respondent No.3-Collector/District Election Officer, Ambikapur, District Surguja (C.G.) on 25.10.2024, despite that, the same has not been decided yet, therefore, counsel for the petitioner submitted that this petition may be disposed of directing respondent No.3 to decide the representation/application filed by petitioner, within a period stipulated by this Court.

4. Learned counsel appearing for the respondents have no objection to allow the limited prayer of the petitioner.

5. Having considered the facts narrated by counsel for the petitioner, the instant petition is disposed of directing the respondent No.3-Collector/District Election Officer, Ambikapur, District Surguja (C.G.) to decide the

representation/application (Annexure-P/3) dated 25.10.2024 filed by

petitioner as early as possible, before publication of final voter list.
