1. Both the petitions have been filed against the issuance of notice dated 09.01.2019 by the Municipal Council, Kawardha whereby the petitioners were directed to remove the encroachment.

1. Learned counsel for the petitioners would submit that before issuance of notice, no opportunity of hearing was afforded to the petitioners.

¶55

1. On the other hand, learned counsel for the State would submit that earlier an order was passed for the removal of encroachment and again the petitioners encroached over the government land, therefore, the notices were issued.

1. Heard counsel appearing for the parties and perused the documents present on record.

¶57

1. Taking into consideration the fact that no opportunity of hearing was afforded to the petitioners before issuance of notice for removal of encroachment, at this juncture, these petitions are hereby disposed

of with liberty to the petitioners to make a representation before the Municipal Authorities within a period of seven days and the authorities shall decide the representations of the petitioners strictly in accordance with law within a further period of 15 days from the date of receipt of a copy of this order. Till then, the interim order granted earlier shall continue.
