Learned counsel for the petitioners submits that plaintiff has filed the civil suit bearing Civil Suit Class A/4/2020 against the defendants for declaration of illegality and nullity of sale deed and also to declare his title and permanent injunction. The aforesaid suit is pending consideration before the Civil Judge (Senior Division) Kasdol, District Balodabazar (C.G.) at the stage of defendants’ evidence. Subsequently, plaintiff filed the application under Order 7 Rule 14 of CPC (Annexure-P/5) for production of documents and taking it on the record, which has been allowed by the trial Court vide impugned order dated 12.09.2024 (Annexure-P/1), thereafter, case was fixed for defendants evidence on 24.09.2024. On the same day, plaintiff has filed the application under Order 18 Rule 17 of CPC (Annexure-P/7) for re-examination of the plaintiff and to get exhibit those documents. It is further submitted that although, documents filed by the plaintiff are certified copy of revenue records, but it has been filed after a huge delay, therefore, trial Court ought not to have allowed the said application, but without considering the huge delay in filing aforesaid application, trial Court has allowed the same vide impugned order. Hence, it is prayed that this petition may be allowed and impugned order dated 12.09.2024 (Annexure-P/1) may be set aside and application filed by the plaintiff under Order 7 Rule 14 of CPC may be rejected.
