The petitioner/defendant has filed an application for returning the original documents i.e. partnership deed (Annexure P/9), Authority Letter on behalf of Firm (Annexure P/10), Sale Agreement (Annexure P/1), Delivery Challan No.2464 (Annexure P/2), letter dated 06.02.2019 addressed to Police Station Incharge Pithora (Annexure P/7) and non-cognizable offence information report (Annexure P/8). The trial Court has, vide impugned order, made a specific observation that after comparing with the original, a copy has been kept on record and allowed the application for returning of the said documents. Petitioner has raised a grievance that the sale agreement, which has been filed before the Court contained 3 pages but the copy which has been supplied to him contained only 2 pages, however, when a query has been put to counsel for the petitioner that at the time of filing of the plaint whether the said copy has been received by him or not he submits that he is not aware of the same. Therefore, this Court only observes that if proper copy of the sale agreement has not been given to the petitioner herein after comparing with the copy which was received by him at the time of filing of the plaint, the trial Court may provide a copy of the said documents (Ex. P-1) as the same has duly been marked and the petitioner would be at liberty to obtain the certified copy of the same.
