Applicant has filed this first bail application under Section 439 of CrPC for grant of regular bail as he was arrested in connection with Crime No. 309 of 2023 registered at Police Station Rajendra Nagar, District – Raipur (C.G.) for offence punishable under Section 420 of I.P.C..

Case of the prosecution is that, complainant has lodged a written report alleging that one Pankaj Tripathi used to give him the phone call on the ground that if he will purchase insurance policy from Max Life Insurance, he will get higher returns based upon which complainant purchased insurance policy in the name of his wife, however after maturity, the amount of insurance policy was

not returned to him. Based upon which aforementioned report was lodged. During investigation, applicant was arrested on 25.09.2023.

Pursuant to notice issued by this Court, complainant is present before this Court through virtual mode from DLSA Raipur. He submits that he has been returned the entire amount which was deposited by him and he entered into settlement with applicant. He also submits that he is having no objection in grant of bail to the applicant.

Learned counsel for applicant submits that application under Section 320 (2) of Cr.P.C. was filed before learned Sessions Court along with affidavit of complainant, however, the learned Court below has not taken into consideration the same. He also contended that entire amount of Rs. 15,08,427/- which was deposited by complainant, was returned.

Learned State counsel opposes the submission made by learned counsel for applicant and submits that in the written report, two instances of cheating has been alleged. One of fraud committed through insurance policy and the other is of cheating and withdrawing of amount from his bank account online. She further submits that 22 mobile phones and 7 policy bonds were seized from the possession of applicant.

I have heard learned counsel for the parties and also perused the documents enclosed with bail application.

Taking into consideration the submission made by learned

counsel for the parties, submission of complainant before this Court without commenting anything on merits of the case, I am inclined to enlarge the applicant on bail.

Accordingly, the bail application is allowed. It is directed that the applicant shall be released on regular bail, upon furnishing a bail bond in the sum of Rs. 25,000/- with one surety in the like sum to the satisfaction of the Court on the conditions that -
