dated 14.01.1998, passed by the IVth Civil Judge Class- I Bilaspur in Civil Suit No. 26A/1995. In Civil Suit No. 26A/1995, the Appellants No. 1 and 2 sold the property in question by way of registered sale deed dated 28.10.1996 to Appellants No. 3 and 4, as such, the application under Order 1 Rule 10 CPC on behalf of Shri Subhash Agrawal and Smt. Leela Devi Agrawal that is Appellants No. 3 and 4 was filed and a similar separate application was also filed by Appellants no. 1 and 2 and thereafter, this Court in its order dated 13.09.2010 allowed the said application filed under Order 1 Rule 10 CPC. Thereafter, Respondents no. 1 to 3 had reported that the Respondent no. 6 as well as 7 have died and for that reason a week’s time has been pleaded from this Court to move an appropriate application. Thereafter, the matter was listed on 24.02.2015 and 08.11.2016 subsequently but on that dates also the Court granted time to the appellants for filing an appropriate application for removing the default, however, on 08.11.2016 the Court has been pleased to observe that “Failure in doing so shall lead to automatic dismissal of the appeal without further reference to the Court”
